


{"id":20543,"date":"2024-02-16T12:22:50","date_gmt":"2024-02-16T06:52:50","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20543"},"modified":"2025-04-06T02:01:11","modified_gmt":"2025-04-05T20:31:11","slug":"uapa","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/uapa\/","title":{"rendered":"What is Unlawful Activities (Prevention) Act, 1967 (UAPA)?"},"content":{"rendered":"<h2>About Unlawful Activities (Prevention) Act, 1967 (UAPA)<\/h2>\n<ul>\n<li>The UAPA was introduced in 1967 as a legislation\u00a0to set out reasonable restrictions on\u00a0the fundamental freedoms under Article 19(1) of the Constitution, such as freedom of speech, right to assemble peacefully, and the right to form associations.\u00a0<\/li>\n<li>Over the years, terror-specific legislations like the Terrorist and Disruptive Activities (Prevention) Act (TADA) and Prevention of Terrorism Act (POTA) were repealed after running into legal trouble, and the UAPA\u00a0became the primary anti-terror legislation in India.\u00a0<\/li>\n<li>In line with its stated objectives, the UAPA\u00a0punishes the commission, funding, and support\u00a0of \u201cunlawful activities\u201d and \u201cterrorist acts\u201d.<\/li>\n<li>It lays down the definitions and rules for\u00a0designating an organization as an &#8220;unlawful association&#8221; if it is engaged in certain types of activities.<\/li>\n<li>\u2018Unlawful activity\u2019 is defined as any action taken by an individual or association \u2013 through an act, words, spoken or written, or by signs or visible representation \u2013 which is intended to, or supports a claim to, bring about the cession of a part of the territory of India, or the secession of a part of the territory of India from the Union, or which incites any individual or group of individuals to bring about such cession or secession.<\/li>\n<li>It\u00a0covers activities which disclaim, question, disrupt, or are intended to disrupt the\u00a0sovereignty and territorial integrity of India, and which cause or intend to cause\u00a0disaffection against India.<\/li>\n<li>In 2004,\u00a0the UAPA\u00a0was amended, and &#8216;terrorist activities&#8217; were brought within its fold, under which 34 outfits, including the Lashkar-e-Taiba and the Jaish-e-Mohammad, were banned.<\/li>\n<li>Under the Act, the central\u00a0government may designate an organization as a terrorist organization if it:\n<ul>\n<li>commits or\u00a0participates in acts of terrorism;<\/li>\n<li>prepares for terrorism;<\/li>\n<li>promotes terrorism;<\/li>\n<li>is otherwise\u00a0involved in terrorism;<\/li>\n<\/ul>\n<\/li>\n<li>The 2019 Amendment gave the Home Ministry the power to designate individuals as terrorists.<\/li>\n<li>The Act\u00a0extends to the whole of India.<\/li>\n<li>The UAPA\u00a0applies to anyone who commits a UAPA crime in India or outside India. It applies to\u00a0Indian citizens irrespective of where the crime is committed, and also\u00a0includes people in Government service, and\u00a0people on ships and aircrafts registered in India.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is the punishment under UAPA?<\/h3>\n<p>The UAPA punishes anyone who takes part in unlawful activities, or who assists in committing such unlawful activities.
