


{"id":20707,"date":"2024-02-21T08:49:11","date_gmt":"2024-02-21T03:19:11","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20707"},"modified":"2025-04-06T03:08:37","modified_gmt":"2025-04-05T21:38:37","slug":"ndps","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/ndps\/","title":{"rendered":"What is the Narcotic Drugs and Psychotropic Substances (NPDS) Act, 1985?"},"content":{"rendered":"<h2>About Narcotic Drugs and Psychotropic Substances (NPDS) Act, 1985<\/h2>\n<ul>\n<li>The NDPS Act\u00a0prohibits any individual\u00a0from engaging in any activity consisting of the\u00a0production, cultivation, sale, purchase, transport, storage, and\/or\u00a0consumption of any narcotic drug or psychotropic substance.<\/li>\n<li>Objectives:\n<ul>\n<li>To\u00a0take measures for preventing, combating, and regulating\u00a0operations relating to narcotic drugs and psychotropic substances.<\/li>\n<li>To\u00a0provide for the forfeiture of property derived from or used in, illicit traffic in narcotic drugs and psychotropic substances.<\/li>\n<li>To\u00a0implement the provisions of the international conventions on Narcotic Drugs and Psychotropic Substances and for all relevant matters.<\/li>\n<li>To\u00a0add or omit the list of psychotropic substances.<\/li>\n<\/ul>\n<\/li>\n<li>What are Narcotic Drugs and Psychotropic Substances?\n<ul>\n<li>\u201cNarcotic Drug\u201d means coca leaf, cannabis (hemp), opium, popy straw, and\u00a0includes all manufactured drugs.<\/li>\n<li>\u201cPsychotropic substance\u201d means any\u00a0substance, natural or synthetic, or any natural material or any salt or preparation of such substance or material included\u00a0in the list of psychotropic substances specified in the Schedule.<\/li>\n<\/ul>\n<\/li>\n<li>Applicability:\u00a0The NDPS Act\u00a0prohibits a person from manufacture \/ production \/ cultivation\/ possession\/ sale \/ purchase \/ transport \/\u00a0store \/ consume any narcotic drug or psychotropic substance\u00a0without due permission from the appropriate authorities.<\/li>\n<li>Punishment under the NDPS Act:\n<ul>\n<li>The Act follows a\u00a0graded system of punishment, with the punishment varying and the quantum of punishment being\u00a0dependent upon whether the offence pertains to small, commercial, and intermediate quantities of narcotic drugs and psychotropic substances.<\/li>\n<li>For offences involving commercial quantities of drugs, a\u00a0minimum penalty of ten years\u00a0of\u00a0rigorous imprisonment is prescribed, which\u00a0may extend to twenty years.<\/li>\n<li>Repeat offences attract one and a half times the penalty and, in a few cases, even the death penalty.<\/li>\n<li>By amendment to the Act in 1989, due to the serious nature of the offence, the\u00a0sentence awarded under the NDPS Act became non-commutable\u00a0except for the sentence awarded\u00a0for the consumption of drugs.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>Alongside these stringent provisions, the\u00a0Act has procedural safeguards as follows:\n<ul>\n<li>Personal search: Any person being searched has a\u00a0right to be searched before a Gazetted Officer or a Magistrate (Section 50).<\/li>\n<li>Searches:\u00a0Gazetted Officers of the empowered Departments\u00a0can authorize searches. Such authorization has to be\u00a0based on information taken down in writing.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li>Searches\u00a0can be made under certain circumstances without a warrant (from a magistrate) or an authorization (from a Gazetted Officer).\u00a0\n<ul>\n<li>Arrests: The\u00a0person\u00a0who is arrested should be informed, as soon as may be, the grounds of his arrest [Section 52(1)].<\/li>\n<\/ul>\n<\/li>\n<li>If the arrest or seizure is based on a warrant issued by a magistrate, the person or the seized article should be forwarded to that magistrate.<\/li>\n<li>The officer who arrests a person has to make a full report to his official superior within 48 hours.<\/li>\n<li>Immunities:\n<ul>\n<li>Officers: Officers acting in discharge of their duties in good faith under the Act are\u00a0immune from suits, prosecution, and other legal proceedings.<\/li>\n<li>Addicts:\u00a0Addicts charged\u00a0with consumption\u00a0of drugs or with\u00a0offences involving small quantities will be\u00a0immune from prosecution\u00a0if they volunteer for\u00a0de-addiction. This immunity may be withdrawn if the addict does not undergo complete treatment.<\/li>\n<li>Offenders:\u00a0Central or state governments can tender immunity to an offender in order\u00a0to obtain his evidence in the case. This immunity is\u00a0granted by the government and not by the court.<\/li>\n<li>Juvenile offenders: Juvenile offenders (below 18 years of age) will be\u00a0governed by the Juvenile Justice (Care and Protection of Children) Act,\u00a02000.<\/li>\n<li>Immunities to diplomats as applicable.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is anticipatory bail?\u00a0<\/h3>\n<p>It is the bail granted to a person in anticipation and apprehending arrest. Under Section 438 of CrPC, any individual who discerns that he may be tried for a non-bailable offense can apply for anticipatory bail.
