


{"id":20711,"date":"2024-02-21T01:12:49","date_gmt":"2024-02-20T19:42:49","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20711"},"modified":"2025-04-06T03:10:14","modified_gmt":"2025-04-05T21:40:14","slug":"mcc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/mcc\/","title":{"rendered":"What is the Model Code of Conduct (MCC)?"},"content":{"rendered":"<h2>About Model Code of Conduct (MCC)<\/h2>\n<ul>\n<li>MCC s a\u00a0set of guidelines intended\u00a0to regulate political parties and candidates\u00a0during elections\u00a0to ensure that the conduct of polls by the Election Commission of India (ECI)\u00a0is free and fair.<\/li>\n<li>This is something\u00a0political parties and candidates voluntarily agree to.<\/li>\n<li>Divided into eight parts, the guidelines\u00a0cover dos and don\u2019ts for electioneering as well as\u00a0on publication of advertisements at the cost of the exchequer, among other things.<\/li>\n<li>The ECI ensures observance of the MCC by a political party in power and contesting candidates for conducting free and fair elections under Article 324 of the Constitution of India.<\/li>\n<li>The salient features of the Model Code of Conduct lay down how political parties, contesting candidates and party(s) in power should conduct themselves during the process of elections i.e. on their\u00a0general conduct during electioneering, holding meetings and processions, poll day activities and functioning of the party in power etc.<\/li>\n<li>MCC also\u00a0ensures that official machinery for electoral purposes is not misused. Further, it is also\u00a0ensured that electoral offenses, malpractices, and corrupt practices are prevented by all means. In case of violation, appropriate measures are taken.<\/li>\n<li>The code\u00a0comes into effect from the time the EC announces the schedule of elections and will be in force till the results are announced.<\/li>\n<li>Applicability:\n<ul>\n<li>During general\u00a0elections to the Lok Sabha, the code is applicable throughout the country.<\/li>\n<li>During general\u00a0elections to the Legislative Assembly of the state, the code is\u00a0applicable in the entire State.<\/li>\n<li>During bye-elections, the MCC would be\u00a0applicable in the area of the concerned Constituency only.<\/li>\n<\/ul>\n<\/li>\n<li>Is MCC Legally Enforceable?<\/li>\n<li>The MCC by itself is\u00a0not legally enforceable but\u00a0certain provisions of the MCC may be\u00a0enforced through\u00a0invoking corresponding provisions in\u00a0other statutes such as the Representation of the People Act, 1951, IPC and CrPC.\u00a0<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is the Election Commission of India (ECI)?<\/h3>\n<p>ECI is an autonomous constitutional authority responsible for administering Union and State election processes in India.
