


{"id":20759,"date":"2024-02-22T03:23:33","date_gmt":"2024-02-21T21:53:33","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20759"},"modified":"2025-04-06T07:30:59","modified_gmt":"2025-04-06T02:00:59","slug":"cpp","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/cpp\/","title":{"rendered":"What is the Committee of Privileges in Parliament?"},"content":{"rendered":"<h2>What is the meaning of Parliamentary Privileges?<\/h2>\n<ul>\n<li>Each House of Parliament\u00a0and its Committees collectively and members of each House individually\u00a0enjoy certain rights, privileges, and immunities without which they cannot perform their functions efficiently and effectively.<\/li>\n<li>The object of parliamentary privilege is\u00a0to safeguard the freedom,\u00a0authority and dignity of Parliament.<\/li>\n<li>They are\u00a0enjoyed by individual members, because the House cannot perform its functions without unimpeded use of the services of its members\u00a0and by each House collectively\u00a0for the protection of its members and the vindication of its own authority and dignity.<\/li>\n<li>But they are\u00a0available to individual members only insofar as they are necessary for the House to perform its functions freely without any let or hindrance.<\/li>\n<li>They\u00a0do not exempt the members from the obligations to the society which apply to other citizens.<\/li>\n<li>When\u00a0any of these rights and immunities, both of the members, individually, and of the assembly in its collective capacity,\u00a0are disregarded or denied by any individual or authority, the offence is\u00a0called a breach of privilege, and is\u00a0punishable under the law of Parliament.<\/li>\n<li>Articles 105 and 194 of the Constitution\u00a0deal with the powers, privileges, and immunities\u00a0of Members of Parliament\/State Legislatures, and\u00a0their House, Members,\u00a0and Committees.<\/li>\n<li>Each House also claims the right to punish actions\u00a0which, while not breaches of any specific privilege,\u00a0are offences against its authority or dignity, such as disobedience to its legitimate commands or libels upon itself, its officers, or its members.\u00a0Such actions, though called \u2018breaches of privilege\u2019, are aptly distinguished as \u2018contempts\u2019.<\/li>\n<\/ul>\n<h2>About Committee of Privileges in Parliament<\/h2>\n<ul>\n<li>This committee consists of\u00a015 members in Lok Sabha (10 in the case of Rajya Sabha)\u00a0nominated by the Speaker (Chairman in the case of Rajya Sabha).<\/li>\n<li>In the\u00a0Rajya Sabha, the deputy chairperson heads the committee of privileges.<\/li>\n<li>Powers and Functions:\n<ul>\n<li>o The committee\u00a0examines every question involving a breach of privilege of the House, or of the members, or of any Committee thereof\u00a0referred to it by the House or by the Speaker\/Chairman.\u00a0<\/li>\n<li>o It\u00a0also determines, with reference to the facts of each case,\u00a0whether a breach of privilege is involved and\u00a0makes suitable recommendations in its report.<\/li>\n<li>o It also\u00a0states the procedure to be followed by the House\u00a0in giving effect to its recommendations.<\/li>\n<li>o When a question of privilege is referred to the Committee by the House, the\u00a0report of the Committee is presented to the House by the Chairman or, in his absence, by any member of the Committee.<\/li>\n<li>o Where a question of privilege is\u00a0referred to the Committee by the Speaker,\u00a0the report\u00a0of the Committee\u00a0is presented to the Speaker, who may pass final orders\u00a0thereon or direct that it be laid on the table of the House.<\/li>\n<li>o The\u00a0Speaker\/Chairman may refer to the Committee any petition regarding the disqualification of a member on the ground of defection\u00a0for making a preliminary inquiry and submitting a report to him.<\/li>\n<li>o The procedure to be followed by the Committee in these cases is, so far as may be, the same as that applicable to questions of breach of privilege.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What are Parliamentary Committees?<\/h3>\n<p>Parliamentary Committee means a committee which is appointed or elected by the House or nominated by the Speaker and which works under the direction of the Speaker and presents its report to the House or to the Speaker and the Secretariat for which is provided by the Lok Sabha Secretariat. 2.
