


{"id":20885,"date":"2024-02-25T07:28:12","date_gmt":"2024-02-25T01:58:12","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=20885"},"modified":"2025-04-06T08:19:38","modified_gmt":"2025-04-06T02:49:38","slug":"section-354-ipc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/section-354-ipc\/","title":{"rendered":"What is Section 354 of the Indian Penal Code (IPC)?"},"content":{"rendered":"<h2>About Section 354 of IPC<\/h2>\n<ul>\n<li>Section 354 of the IPC\u00a0states that anyone who assaults or uses criminal force against a\u00a0woman\u00a0with the intention of outraging her modesty, or knowing that such an act is likely to outrage her modesty,\u00a0can be punished with imprisonment ranging\u00a0from one to five years and may also be fined.<\/li>\n<li>It has been enacted with a view to\u00a0protect a woman against indecent assault as well as to\u00a0safeguard public morality and decent behaviour.\u00a0<\/li>\n<li>This section punishes an assault or use of criminal force on any woman with the intention or knowledge that the woman\u2019s modesty will be outraged.<\/li>\n<li>The\u00a0essential ingredients of the offense under Section 354 of the IPC are as follows:\n<ul>\n<li>that the\u00a0person assaulted must be a woman<\/li>\n<li>that the\u00a0accused should have\u00a0used some sort of criminal force on her<\/li>\n<li>Criminal force must have been\u00a0used to outrage her modesty<\/li>\n<li>There must be an\u00a0intention to do so. It is the\u00a0section\u2019s substance, where the choice of punishment and the legitimacy of the charges is evaluated.<\/li>\n<\/ul>\n<\/li>\n<li>What constitutes an \u2018outrage to female modesty\u2019 has\u00a0not been defined anywhere under the IPC. It is rather\u00a0subject to the facts and circumstances of each case.\u00a0<\/li>\n<li>It\u00a0does not encompass offences committed against men in the same manner.\u00a0<\/li>\n<li>An offence under Section 354 of the IPC shall be a\u00a0cognizable and a non-bailable offence that is\u00a0triable by a magistrate of any class.\u00a0<\/li>\n<li>The\u00a0Criminal Law Amendment Act of 2013\u00a0introduced four additional subsections to Section 354 of IPC to broaden its scope. These are the following:\n<ul>\n<li>Section 354A:\u00a0Sexual harassment and punishment for sexual harassment<\/li>\n<li>Section 354B:\u00a0Assault or use of\u00a0criminal force to woman with intent to disrobe<\/li>\n<li>Section 354C:\u00a0Voyeurism\u00a0<\/li>\n<li>Section 354D:\u00a0Stalking<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is the Criminal Law Amendment Act of 2013?<\/h3>\n<p>The Criminal Law (Amendment) Act, 2013 was passed in the aftermath of the Nirbhaya case wherein a female student was gang-raped in December 2012. The Act amended several provisions of the Indian Penal Code, Indian Evidence Act, and the Criminal Procedure Code. By way of this amendment, several new offenses have been recognized and incorporated into the Indian Penal Code, including acid attack (Section 326 A &amp; B), voyeurism (Section 354C), stalking (Section 354D), attempt to disrobe a woman (Section 354B), sexual harassment (Section 354A), and sexual assault which causes death or injury causing a person to be in persistent vegetative state (Section 376A).
