{"id":21038,"date":"2024-02-29T06:09:49","date_gmt":"2024-02-29T00:39:49","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=21038"},"modified":"2025-04-06T09:23:25","modified_gmt":"2025-04-06T03:53:25","slug":"ncbc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/ncbc\/","title":{"rendered":"National Commission for Backward Classes (NCBC)"},"content":{"rendered":"<h2>About National Commission for Backward Classes (NCBC)<\/h2>\n<ul>\n<li>NCBC was\u00a0initially constituted by the Central Government\u00a0by the National Commission for Backward Classes Act, 1993, under the\u00a0Ministry of Social Justice and Empowerment.<\/li>\n<li>It has been\u00a0accorded constitutional status through \u201cThe Constitution (One Hundred and Second Amendment) Act, 2018\u201d, whereby\u00a0Article 338B has been inserted, forming a\u00a0Commission for the socially and educationally backward classes to be known as the NCBC.\u00a0\n<ul>\n<li>The amendment inserted Article 338B, Article 342A, and Clause 26C in Article 366.<\/li>\n<\/ul>\n<\/li>\n<li>Composition: The Commission consists of a\u00a0Chairperson, a Vice-Chairperson, and\u00a0three other Members in the\u00a0rank and pay of Secretary to the Government of India.<\/li>\n<li>The Chairperson, Vice-Chairperson and other Members of the Commission shall be\u00a0appointed by the President by warrant under his hand and seal.<\/li>\n<li>Functions: It shall be the duty of the Commission\n<ul>\n<li>to\u00a0investigate and monitor\u00a0all matters\u00a0relating to the safeguards provided for the\u00a0socially and educationally backward classes under this Constitution or under any other law for the time being in force or under any order of the Government, and to\u00a0evaluate the working of such safeguards;<\/li>\n<li>to\u00a0inquire into specific complaints with respect to the deprivation of rights and safeguards of the socially and educationally backward classes;<\/li>\n<li>to\u00a0participate and advise on the socio-economic development of the socially and educationally backward classes and to evaluate the progress of their development under the Union and any State;<\/li>\n<li>to\u00a0present to the President, annually and at such other times as the Commission may deem fit,\u00a0reports upon the working of those safeguards;<\/li>\n<li>to make\u00a0in such reports recommendations as to the measures that should be taken by the Union or any State for the effective implementation of those safeguards and other measures for the protection, welfare, and socio-economic development of the socially and educationally backward classes;<\/li>\n<li>to\u00a0discharge such other functions in relation to the protection, welfare, and development and advancement of the socially and educationally backward classes\u00a0as the President may,\u00a0subject to the provisions of any law made by Parliament, by rule specify<\/li>\n<\/ul>\n<\/li>\n<li>The\u00a0President\u00a0shall cause\u00a0all such reports to be laid before each House of Parliament along with a\u00a0memorandum explaining\u00a0the action taken or proposed to be taken\u00a0on the\u00a0recommendations relating to the Union and the\u00a0reasons for the non-acceptance, if any, of any of such recommendations.<\/li>\n<li>Powers:\n<ul>\n<li>While inquiring into any complaint, it will have all the\u00a0powers of a civil court (it will be able to summon any person, ask for a document, and receive evidence on affidavits).<\/li>\n<li>The Union and every State\u00a0Government shall consult the Commission\u00a0on all major policy matters\u00a0affecting the socially and educationally backward classes.<\/li>\n<li>The Commission shall have the\u00a0power to regulate its own procedures.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is Article 342A?<\/h3>\n<p>The Constitution (One Hundred and Second) Amendment Act 2018 has inserted Article 342-A in the Constitution of India pertaining to the Central List of Socially and Educationally backward Classes (SEBCs &#8211; commonly known as other backward classes &#8211; OBCs), which had authorized the President to specify the Central list of the SEBCs, in relation to a particular State or Union Territory.
