{"id":21204,"date":"2024-03-04T07:33:38","date_gmt":"2024-03-04T02:03:38","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=21204"},"modified":"2025-04-06T10:34:06","modified_gmt":"2025-04-06T05:04:06","slug":"dmr","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/dmr\/","title":{"rendered":"Drugs and Magic Remedies(Objectionable Advertisements) Act, 1954"},"content":{"rendered":"<h2>About Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954<\/h2>\n<ul>\n<li>It is a legislative framework to\u00a0control the advertisement of drugs and prohibit claims of magical qualities in remedies.<\/li>\n<li>It encompasses various forms of\u00a0advertisements, including written, oral, and visual mediums.<\/li>\n<li>Under the Act,\u00a0the term \u201cdrug\u201d refers to medicines intended for human or animal use, substances for diagnosis or treatment of diseases, and articles affecting the body\u2019s functions.<\/li>\n<li>Other than articles meant for consumption, the definition for \u201cmagic remedy\u201d under this Act also extends to\u00a0talismans, mantras, and charms that allegedly possess miraculous powers for healing or influencing bodily functions.<\/li>\n<li>It imposes strict regulations on the publication of advertisements related to drugs.<\/li>\n<li>It prohibits advertisements that give\u00a0false impressions, make\u00a0false claims, or are otherwise misleading.<\/li>\n<li>Violations of these provisions can result in penalties, including imprisonment or fines, upon conviction.<\/li>\n<li>The term \u201cadvertisement,\u201d under the Act, extends to all notices, labels, wrappers, and oral announcements.<\/li>\n<li>Who comes under the Magic Remedies Act?\n<ul>\n<li>The Act applies to all\u00a0individuals and entities involved in the publication of advertisements,\u00a0including manufacturers, distributors, and advertisers.<\/li>\n<li>The Act can hold both individuals and companies accountable for contraventions.<\/li>\n<li>If a company violates the act, individuals in charge of its business operations may also be deemed guilty unless they can prove lack of knowledge or demonstrate due diligence in preventing the offense.<\/li>\n<li>Directors, managers, or officers of the company may also be held liable if they consented to or neglected the offense.<\/li>\n<\/ul>\n<\/li>\n<li>Punishment\n<ul>\n<li>Violating the Act can result in\u00a0imprisonment, fines, or both.<\/li>\n<li>If this is the first conviction for the violator, they may face up to six months in prison, fines or both.<\/li>\n<li>For subsequent conviction, imprisonment may extend to one year, fine, or both.<\/li>\n<li>The Act does not include any limits for the fines that may be imposed on individuals or organisations.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is Active Pharmaceutical Ingredient (API)?<\/h3>\n<p>It is the biologically active component of a drug product (tablet, capsule, cream, injectable) that produces the intended effects.
