


{"id":21355,"date":"2024-03-08T08:53:18","date_gmt":"2024-03-08T03:23:18","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=21355"},"modified":"2025-04-06T11:40:46","modified_gmt":"2025-04-06T06:10:46","slug":"article-131-of-indian-constitution","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/article-131-of-indian-constitution\/","title":{"rendered":"What is Article 131 of the Indian Constitution?"},"content":{"rendered":"<h2>About Article 131 of the Indian Constitution<\/h2>\n<ul>\n<li>According to Article 131, the\u00a0SC has exclusive and original jurisdiction\u00a0over\u00a0legal issues originating\u00a0between states or between states and the union.\n<ul>\n<li>Original jurisdiction\u00a0is the power of the court\u00a0to hear and determine a dispute in the first instance.<\/li>\n<\/ul>\n<\/li>\n<li>The\u00a0bare reading\u00a0of Article 131 states that &#8211; Original jurisdiction of the SC:\n<ul>\n<li>Subject to the provisions of this Constitution, the\u00a0SC shall,\u00a0to the exclusion of\u00a0any other court,\u00a0have original jurisdiction\u00a0in\u00a0any\u00a0dispute:\n<ul>\n<li>between the\u00a0Government of India\u00a0and one or more\u00a0States; or<\/li>\n<li>between the Government of India and any State or States on one side and one or more other States on the other; or<\/li>\n<li>between two or more States, if and in\u00a0so far as\u00a0the\u00a0dispute involves any question (whether of law or fact)\u00a0on which\u00a0the existence or extent\u00a0of a legal right depends.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>The nature of Article 131\u00a0is subject to provisions of the Constitution and is limited to disputes involving legal rights, as mentioned in the Article itself.\n<ul>\n<li>Thus,\u00a0disputes of political nature are not covered under this,\u00a0unless legal rights are at stake.<\/li>\n<\/ul>\n<\/li>\n<li>The SC held that the meaning of the\u00a0word \u2018State\u2019 under Article 131\u00a0does not include any\u00a0private citizen, company, or a government department, even if it had filed a complaint along with any State Governments.<\/li>\n<li>Restrictions:\n<ul>\n<li>The original jurisdiction of the SC\u00a0does not extend to disputes\u00a0arising\u00a0out\u00a0of any\u00a0treaty, agreement, covenant, engagement, sanad, or any other similar instrument\u00a0which came into being before the commencement of the\u00a0Constitution.<\/li>\n<li>The\u00a0parliament may exclude the jurisdiction of the SC\u00a0in disputes relating to the use, distribution, or\u00a0control of the water of any inter-state river;<\/li>\n<li>Suits brought by private individuals against the government of India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What are Legal Rights?<\/h3>\n<p>Legal rights are the rights provided by the way of acts and legislation. It is recognized and protected by law. These rights affect every citizen. There is no remedy for the infringement of these except for the law itself. Legal rights can be differentiated from moral rights or natural rights or even fundamental rights. E.g.
