{"id":21767,"date":"2024-03-22T09:14:53","date_gmt":"2024-03-22T03:44:53","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=21767"},"modified":"2025-04-06T15:12:17","modified_gmt":"2025-04-06T09:42:17","slug":"section-153a-of-indian-penal-code","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/section-153a-of-indian-penal-code\/","title":{"rendered":"What is Section 153A of the Indian Penal Code (IPC)?"},"content":{"rendered":"<h2>About Section 153A of the IPC<\/h2>\n<ul>\n<li>Section 153A of the IPC attempts to\u00a0punish those who engage in promoting any kind of\u00a0enmity among different groups\u00a0on the basis of religion, caste, race, place of birth or residence, or even language.<\/li>\n<li>The provision\u00a0puts a liability on those who\n<ul>\n<li>Spread enmity in the\u00a0form of words (spoken or written),\u00a0visual representations,\u00a0and\u00a0signs with the intention of causing disharmony, hatred, or disturbance among people belonging to different groups, religions, castes, or communities.<\/li>\n<li>Spread disharmony and\u00a0disturb the public tranquility\u00a0of the people\u00a0belonging\u00a0to different racial and religious groups.<\/li>\n<li>Aid in the organising of certain movements, drills\u00a0that encourage as well as\u00a0train the participants of such movements\u00a0to use criminal force and violence\u00a0upon people belonging to other racial and religious\u00a0groups and communities.<\/li>\n<\/ul>\n<\/li>\n<li>Offence on moral turpitude is\u00a0also covered in this section.<\/li>\n<li>The offence is a\u00a0cognizable offence and\u00a0the punishment for the same\u00a0may extend to three years, or with fine, or with both.<\/li>\n<li>However, the\u00a0punishment\u00a0of the\u00a0offence committed in a place of worship is enhanced up to\u00a0five years and a fine.<\/li>\n<li>Further, the offence under Section 153A is\u00a0non-bailable in nature, wherein the accused is tried by the magistrate of the first class.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1) What is a cognizable offence?<\/h3>\n<p>A Cognizable offense or case is defined as the one which an officer in-charge of a police station may investigate without the order of a magistrate and effect arrest without warrant.
