


{"id":21947,"date":"2024-03-29T01:56:18","date_gmt":"2024-03-28T20:26:18","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=21947"},"modified":"2025-10-04T11:41:38","modified_gmt":"2025-10-04T06:11:38","slug":"section-120b-of-the-indian-penal-code","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/section-120b-of-the-indian-penal-code\/","title":{"rendered":"What is Section 120B of the Indian Penal Code (IPC)?"},"content":{"rendered":"<h2>About Section 120B of the IPC<\/h2>\n<ul>\n<li>Section 120A of the IPC\u00a0defines the offence of\u00a0criminal conspiracy.<\/li>\n<li>Section 120B of the IPC, on the other hand, defines the\u00a0punishment for criminal conspiracy.<\/li>\n<li>Criminal Conspiracy under IPC is an\u00a0agreement between\u00a0two or more persons to\u00a0commit an illegal act or to\u00a0commit a lawful act by illegal means.<\/li>\n<li>In other words, it is a criminal offence where two or more individuals agree to plan and execute a criminal act.<\/li>\n<li>Section 120A of the IPC states: \u201cWhen two or more persons agree to do or cause to be done, an illegal act or an act which is not illegal by illegal means, such an agreement is designated a criminal conspiracy.\u201d<\/li>\n<li>For a conspiracy to be established, there\u00a0must be an agreement between the conspirators,\u00a0a common intention to commit an illegal act, and\u00a0an overt act in furtherance of that intention.<\/li>\n<li>The\u00a0agreement\u00a0does not have to be in writing\u00a0or expressed verbally; it\u00a0can be inferred from the conduct of the parties.<\/li>\n<li>The Doctrine of Agency in a Criminal Conspiracy:\n<ul>\n<li>It is said that a\u00a0criminal conspiracy\u00a0is a partnership in crime\u00a0because\u00a0every member involved is a joint and mutual agent to each other for the common purpose, i.e., execution of the conspired crime.<\/li>\n<li>By this doctrine of agency, the law contemplates that the\u00a0act of one of the members in the conspiracy\u00a0is deemed as the act by each of them, due to all members being\u00a0equally liable.<\/li>\n<\/ul>\n<\/li>\n<li>Punishment for Criminal Conspiracy:\n<ul>\n<li>Under the purview of IPC 120B, conspiracy is divided into two categories\u00a0depending on the nature,\u00a0gravity, and punishment for the said offences. Also, whether the case is bailable or not, depends on the above-mentioned circumstances.<\/li>\n<li>In the first part, it states that if\u00a0the conspiracy is to commit an offence of serious nature,\u00a0an offence which is\u00a0punishable with\u00a0death imprisonment,\u00a0imprisonment for life,\u00a0or with rigorous imprisonment\u00a0for at least a term of\u00a02 years or more, or if there is\u00a0no punishment mentioned in the code for the offence committed,\u00a0such person shall be treated in the same manner\u00a0as of the\u00a0offence committed and abetted by him.<\/li>\n<li>Whereas, in the other part of Section 120B,\u00a0conspiracy other than the offence committed\u00a0under the first part, conspiracy to commit an illegal act is covered. The court has the power to review its rulings to correct a \u201cpatent error\u201d and not \u201cminor mistakes of inconsequential import\u201d. It is not necessary that only parties to a case can seek a review of the judgment on it.
