


{"id":22080,"date":"2024-04-02T09:46:17","date_gmt":"2024-04-02T04:16:17","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=22080"},"modified":"2025-10-13T12:09:04","modified_gmt":"2025-10-13T06:39:04","slug":"rbi-guidelines-on-penal-charges-on-loan-accounts","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/rbi-guidelines-on-penal-charges-on-loan-accounts\/","title":{"rendered":"Reserve Bank of India&#8217;s (RBI) Guidelines on Penal Charges on Loan Accounts"},"content":{"rendered":"<h2>About RBI Guidelines on Penal Charges on Loan Accounts<\/h2>\n<ul>\n<li>The norms <strong>prohibit commercial banks<\/strong> and finance companies <strong>from charging <\/strong>borrowers\u2019 <strong>penal rates on loan defaults<\/strong> or any other non-compliance event.<\/li>\n<li>Under the new rules, <strong>penalty, if charged<\/strong>, for non-compliance of the material terms and conditions of the loan contract by the borrower should <strong>be treated as \u2018penal charges.<\/strong>\n<ul>\n<li>It <strong>cannot be levied in the form of \u2018penal interest\u2019<\/strong> that is added to the rate of interest charged on the advances.<\/li>\n<\/ul>\n<\/li>\n<li>There should be <strong>no capitalisation of penal charges<\/strong>; that is <strong>no further interest computed<\/strong> on such charges.<\/li>\n<li>The <strong>material terms and conditions<\/strong> will be defined as per the credit policy of the bank, and they may <strong>vary from one category of loan to another<\/strong>, and <strong>from bank to bank<\/strong> based on their own assessment.<\/li>\n<li>There is <strong>no upper limit <\/strong>or cap<strong> for penal charges<\/strong>. However, the guidelines stipulated that the quantum of penal charges would <strong>bereasonable <\/strong>and commensurate with the non-compliance <strong>without being discriminatory<\/strong> within a particular loan category.<\/li>\n<li>The guidelines had also mentioned that the <strong>penal chargesin the caseof loans<\/strong> sanctioned <strong>to individual borrowersfor<\/strong> purposes <strong>other than business will not be higher<\/strong> than the penal charges <strong>applicable to non-individual borrowers<\/strong> for similar non-compliance.\u00a0<\/li>\n<li>Also, in order to prevent banks from imposing arbitrary rates of interest, they are meant to follow a board approved policy on penal charges on similar charges on loans.\u00a0<\/li>\n<li>These guidelines will <strong>not apply to credit cards,<\/strong> which are covered under product specific directions.<\/li>\n<li>The key rationale of the guidelines was that the intent of levying penal charges is meant to <strong>inculcate a sense of credit discipline,<\/strong> and such <strong>charges are not<\/strong> meant to be <strong>used as a revenue enhancementtool<\/strong> over and above the contracted rate of interest.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1: What are Scheduled Commercial Banks?<\/h3>\n<p>A Scheduled Commercial Bank (SCB) is a commercial bank which has been included in the Second Schedule of the Reserve Bank of India Act, 1934 (RBI Act). Conditions for inclusion in the Second Schedule of the RBI Act are as stated in section 42(6)(a) of the RBI Act.<\/p>\n<p>Every SCB enjoys two types of principal facilities: &#8211;<\/p>\n<ul>\n<li>It becomes eligible for debts\/loans at the bank rate from the RBI<\/li>\n<li>It automatically acquires the membership of clearing house.
