{"id":22096,"date":"2024-04-03T09:07:48","date_gmt":"2024-04-03T03:37:48","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=22096"},"modified":"2025-04-06T17:24:09","modified_gmt":"2025-04-06T11:54:09","slug":"khula-under-islamic-law","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/khula-under-islamic-law\/","title":{"rendered":"What is Khula under Islamic Law?"},"content":{"rendered":"<h2>About Khula<\/h2>\n<ul>\n<li>&#8216;Khula&#8217; is a <strong>practice within Islamic<\/strong> law that <strong>empowers Muslim women<\/strong> to <strong>unilaterally seek separation from<\/strong> their <strong>husbands<\/strong>.<\/li>\n<li>It is expressly <strong>mentioned in the Quran.<\/strong><\/li>\n<li>This is designed to <strong>safeguard women&#8217;s rights<\/strong> and operate within the parameters of Islamic law.<\/li>\n<li>The process involves the <strong>wife initiating<\/strong> the divorce <strong>by formally requesting<\/strong> it from the <strong>court<\/strong>, <strong>providing a valid reason<\/strong> such as incompatibility, abuse, or neglect.<\/li>\n<li>In the &#8216;Khula&#8217; process, there is also the <strong>possibility of the womanreturning the &#8216;Mehr&#8217;<\/strong> or reaching a<strong> financial settlement<\/strong> with her husband as part of the agreement for ending the marriage.<\/li>\n<li><strong>Following a &#8216;Khula&#8217;<\/strong> divorce, the <strong>husband assumesresponsibility<\/strong> for the <strong>education and financial support of the children.<\/strong><\/li>\n<\/ul>\n<h2>What is Talaq?<\/h2>\n<ul>\n<li>&#8216;Talaq&#8217; occurs when the <strong>husband initiates the divorce<\/strong>.<\/li>\n<li>According to Muslim law, once a man pronounces &#8216;Talaq,&#8217; the <strong>marriage is immediately terminated.<\/strong><\/li>\n<li>But unlike Khula, wherein a Muslim woman needs to formally give a reason for the divorce, <strong>in Talaq,<\/strong> a Muslim <strong>man can divorce<\/strong> his wife with or<strong> without any cause<\/strong>, and there is <strong>no specific procedure <\/strong>for it.<\/li>\n<\/ul>\n<p>After taking a &#8216;Talaq&#8217;, a <strong>Muslim man<\/strong> has to <strong>repay his former wifeher dowry<\/strong> and <strong>property<\/strong>, if any, owned by her.<\/p>\n<hr \/>\n<h3>Q1: What is Triple Talaq?<\/h3>\n<p>It is a form of divorce that was practiced in Islam, whereby a Muslim man could divorce his wife by pronouncing talaq three times.
