


{"id":22100,"date":"2024-04-03T12:08:19","date_gmt":"2024-04-03T06:38:19","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=22100"},"modified":"2025-10-13T14:24:19","modified_gmt":"2025-10-13T08:54:19","slug":"contempt-of-court","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/contempt-of-court\/","title":{"rendered":"What is Contempt of Court?"},"content":{"rendered":"<h2>About Contempt of Court<\/h2>\n<ul>\n<li><strong>Constitutional Provisions: Article 129 <\/strong>of the Constitution says that the <strong>Supreme Court<\/strong> shall be the \u2018Court of Record\u2019 and it has all the powers of such courts including the <strong>power to punish for contemptof itself<\/strong>. <strong>Article 215<\/strong> conferred a <strong>corresponding power on the High Courts.<\/strong><\/li>\n<li>According to the <strong>Contempt of Courts Act, 1971<\/strong>, <strong>contempt<\/strong> of court <strong>can either be civil<\/strong> contempt <strong>or crimina<\/strong>l contempt.<\/li>\n<li><strong>Civil contempt<\/strong> means <strong>wilful disobediencetoany judgment,<\/strong> decree, direction, order, writ <strong>or other process<\/strong> of a court or <strong>wilful breach of an undertaking given<\/strong> to a court.<\/li>\n<li>On the other hand, <strong>criminal contempt<\/strong> means the <strong>publication<\/strong> (whether by words, spoken or written, or by signs, or by visible representations, or otherwise) <strong>of any matteror the doing <\/strong>of any other act <strong>whatsoever which<\/strong>\n<ul>\n<li><strong>scandalises<\/strong> or tends to scandalise, or <strong>lowers<\/strong> or tends to lower the <strong>authority of, any court<\/strong>; or<\/li>\n<li><strong>prejudices<\/strong>, or <strong>interferes with,<\/strong> or tends to interfere with, the <strong>due course of<\/strong> any <strong>judicial proceeding; or<\/strong><\/li>\n<li><strong>interferes<\/strong> or tends to interfere with, or <strong>obstructs<\/strong> or tends to obstruct, the <strong>administration of justice<\/strong> in any other manner.<\/li>\n<\/ul>\n<\/li>\n<li>A contempt of court may be <strong>punished with simple imprisonment<\/strong> for a term which may <strong>extend to six months<\/strong>, or <strong>with fine<\/strong> which may <strong>extend to two thousand rupees<\/strong>, or with both, provided that the accused may be discharged or the <strong>punishment<\/strong> awarded may be <strong>remitted on apology being made<\/strong> to the satisfaction of the court.<\/li>\n<li><strong>What is not contempt of court?<\/strong><\/li>\n<\/ul>\n<p><strong>Fair and accurate reporting of judicial proceedings<\/strong> will not amount to contempt of court. Nor is any <strong>fair criticismon the merits of a judicial order<\/strong> after a case is heard and disposed of.<\/p>\n<hr \/>\n<h2>Q1: What is the Central Administrative Tribunal (CAT)?<\/h2>\n<p>The CAT had been established under Article 323-A of the Constitution to adjudicate disputes and complaints with respect to the recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the Union or other authorities under the control of the Government.
