{"id":22429,"date":"2024-04-13T10:26:55","date_gmt":"2024-04-13T04:56:55","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=22429"},"modified":"2025-04-06T19:38:19","modified_gmt":"2025-04-06T14:08:19","slug":"vakalatnama","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/vakalatnama\/","title":{"rendered":"What is Vakalatnama?"},"content":{"rendered":"<h2>About Vakalatnama<\/h2>\n<ul>\n<li>It is a <strong>legal document<\/strong> in India that <strong>authorizes an advocate to represent a party<\/strong> in court proceedings.<\/li>\n<li>The term &#8220;Vakalatnama&#8221; is derived from two words: &#8220;Vakalat,&#8221; which means authority or power of attorney, and &#8220;Nama,&#8221; which means a document.<\/li>\n<li>When a person engages the services of a lawyer to represent them in a legal matter, they sign a Vakalatnama, which <strong>formally appoints the lawyer to act on their behalf.<\/strong><\/li>\n<li>This document <strong>outlines the scope of the lawyer&#8217;s authority<\/strong>, <strong>thespecific case<\/strong> or matter for which representation is sought, and other <strong>relevant details.<\/strong><\/li>\n<li>It is also known as a <strong>memo of appearance, Vakilat Patra<\/strong>, VP.<\/li>\n<li>There is <strong>no mention<\/strong> of any particular definition <strong>of Vakalatnama in the Civil Procedure Code<\/strong>, 1908, or the <strong>Power of Attorney Act, 1882.<\/strong><\/li>\n<li>The meaning of Vakalatnama is <strong>defined in the Advocates Welfare Fund Act<\/strong>, 2001, under which \u201cVakalatnama\u201d includes a memorandum of appearance or any other document by which an advocate is empowered to appear or plead before any court, tribunal, or other authority.<\/li>\n<li>The <strong>holder of the vakalatnama<\/strong> is <strong>called a pleader, an advocate, counsel, vakil<\/strong>, or an <strong>attorney<\/strong> who is authorized to accept the vakalatnama on behalf of his client or party of the litigation.<\/li>\n<li><strong>Who can authorize a Vakalatnama?<\/strong>\n<ul>\n<li>An <strong>aggrieved person<\/strong> can authorize a Vakalatnama.<\/li>\n<li><strong>Anybody holding the Power of Attorney for<\/strong> the <strong>aggrieved person.<\/strong><\/li>\n<li><strong>Anybody representingthe aggrieved person<\/strong> in business or trade in that jurisdiction.<\/li>\n<li>A Vakalatnama can also be authorized by a <strong>joint party in a case<\/strong> in order to appoint either a set of advocates or the same advocate.<\/li>\n<\/ul>\n<\/li>\n<li><strong>A good Vakalatnama should contain the following:<\/strong>\n<ul>\n<li>The date the Vakalatnama would be executed<\/li>\n<li>The <strong>name of the case<\/strong>\/cases in which the advocate is being appointed<\/li>\n<li>The <strong>name of the court<\/strong>\/courts in which the advocate is being appointed<\/li>\n<li>The <strong>name of the person authorizing<\/strong> the Advocate\/advocates<\/li>\n<li>If the Vakalatnama is not executed by the issuer in person, then a written document should support the appointment of the advocate<\/li>\n<li>The advocate&#8217;s address so appointed<\/li>\n<li><strong>Types of power granted<\/strong> to the advocate<\/li>\n<li>Signatures of the parties<\/li>\n<li>Advocate&#8217;s signature accepting the Vakalatnama<\/li>\n<\/ul>\n<\/li>\n<li>A vakalatnama <strong>can be revoked <\/strong>or withdrawn <strong>by the client at any time.<\/strong> However, it&#8217;s important to follow the proper legal procedures for revocation, which may vary depending on the jurisdiction.<\/li>\n<li><strong>No Vakalatnamais needed for performing other legal work<\/strong> such as giving opinions, sending notices, drafting petitions, or other documents.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1: What is the Advocates Welfare Fund Act, 2001?<\/h3>\n<p>The Advocates\u2019 Welfare Fund Act, 2001 is an Act to provide for the constitution of a Welfare Fund for the benefit of advocates and for matters connected therewith and incidental thereto.
