


{"id":22509,"date":"2024-04-15T08:55:00","date_gmt":"2024-04-15T03:25:00","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=22509"},"modified":"2025-04-06T20:10:21","modified_gmt":"2025-04-06T14:40:21","slug":"easementary-right","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/easementary-right\/","title":{"rendered":"What is Easementary Right?"},"content":{"rendered":"<h2>About Easementary Right<\/h2>\n<ul>\n<li>The concept of easement has been <strong>defined under<\/strong> Section 4 of <strong>the Indian Easements Act, 1882.<\/strong><\/li>\n<li>According to the provisions of Section 4, an easementary right is a <strong>right possessed by the owner<\/strong> or occupier <strong>of the land on some other land<\/strong>, <strong>not his own,<\/strong> the purpose of which is to <strong>provide the beneficial enjoyment of the land.<\/strong><\/li>\n<li>This right is granted because, without the existence of this right an occupier or owner cannot fully enjoy his own property.<\/li>\n<li>It <strong>includes the right to do<\/strong> or <strong>continue to do something<\/strong> or to <strong>prevent or to continue<\/strong> to <strong>prevent something<\/strong> in connection with or in <strong>respect of some other land<\/strong>, which is not his own, for the enjoyment of his own land.<\/li>\n<li>The word \u2018land\u2019 refers to everything permanently attached to the earth, and the word \u2018beneficial enjoyment\u2019 denotes convenience, advantage or any amenity, or any necessity.<\/li>\n<li>The <strong>owner or occupier<\/strong> referred to in the provision is known as the <strong>Dominant Owner <\/strong>and the <strong>land for the benefit<\/strong> of which the easementary right exists is called <strong>Dominant Heritage<\/strong>.<\/li>\n<li>Whereas the <strong>owner upon whose land the liability is imposed<\/strong> is known as the <strong>Serviant Owner<\/strong> and the <strong>land on which such a liability is imposed to do<\/strong> or prevent <strong>something <\/strong>is known as the <strong>Servient Heritage.<\/strong><\/li>\n<li>Eg: \u2018P\u2019, being the owner of certain land or house, has a right of way over Q\u2019s house, adjacent to his house, to move out of the street. This is known as right of easement.<\/li>\n<\/ul>\n<p>An easement is, in no <strong>way, a transfer of property<\/strong>. It could be <strong>made, altered, or released<\/strong> as well, and <strong>should always be in written form<\/strong>, <strong>except when<\/strong> it has <strong>been enjoyed for a very long time<\/strong> without restrictions.
