


{"id":22742,"date":"2024-04-23T02:54:32","date_gmt":"2024-04-22T21:24:32","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=22742"},"modified":"2025-10-08T11:26:07","modified_gmt":"2025-10-08T05:56:07","slug":"safeguard-measures-under-wto","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/safeguard-measures-under-wto\/","title":{"rendered":"Safeguard Measures under World Trade Organization (WTO)"},"content":{"rendered":"<h2>About Safeguard Measures<\/h2>\n<ul>\n<li>Safeguard measures are measures introduced by a country that qualify as <strong>\u201cemergency\u201d actions under the WTO Agreement on Safeguards<\/strong>.<\/li>\n<li><strong>A WTO member<\/strong> may <strong>take a \u201csafeguard\u201d action<\/strong> (i.e., restrict imports of a product temporarily) under the WTO Agreement on Safeguards <strong>to protect a specific domestic industry from<\/strong> an <strong>increase in imports of any product<\/strong> which is <strong>causing<\/strong>, or which is threatening to cause, <strong>serious injury to the industry<\/strong>.<\/li>\n<li>These actions are intended <strong>to prevent<\/strong> or mitigate <strong>serious injury to the member state\u2019s domestic industry<\/strong>.<\/li>\n<li>Such measures, which in broad terms take the <strong>form of suspension of concessions<\/strong> or obligations, can consist of <strong>quantitative import restrictions or duty increases<\/strong> to <strong>higher than bound rates<\/strong>.<\/li>\n<li>They are <strong>one of three types of contingent trade protection measures<\/strong>, <strong>along with anti-dumping and countervailing measures<\/strong>, available to WTO members.<\/li>\n<li>The <strong>guiding principles<\/strong> of the agreement with respect to safeguard measures are that such measures\n<ul>\n<li>Must be <strong>temporary<\/strong>;<\/li>\n<li>That they may be <strong>imposed only when imports<\/strong> are found to cause or <strong>threaten serious injuryto<\/strong> a competing <strong>domestic industry;<\/strong><\/li>\n<li>That they (<strong>generally) beapplied on a non-selective<\/strong> (i.e., most-favoured-nation, or \u201cMFN\u201d) <strong>basis<\/strong>;<\/li>\n<li>That they be <strong>progressively liberalized<\/strong> while in effect;<\/li>\n<li>And that the <strong>member imposing them<\/strong> (generally) <strong>must pay compensation<\/strong> to the members whose trade is affected.<\/li>\n<\/ul>\n<\/li>\n<li>Thus, safeguard measures, <strong>unlike anti-dumping and countervailing<\/strong> measures, <strong>do not require a finding of an \u201cunfair\u201d practice<\/strong>.<\/li>\n<li>The agreement defines \u201cserious injury\u201d as a significant overall impairment in the position of a domestic industry.<\/li>\n<\/ul>\n<p>In determining whether serious injury is present, investigating authorities are to evaluate all relevant factors having a bearing on the condition of the industry.<\/p>\n<hr \/>\n<h3>Q1: What is Anti-Dumping Duty?<\/h3>\n<p>Anti-dumping duty is a tariff imposed on imports manufactured in foreign countries that are priced below the fair market value of similar goods in the domestic market. The government imposes anti-dumping duty on foreign imports when it believes that the goods are being \u201cdumped\u201d \u2013 through the low pricing \u2013 in the domestic market. Anti-dumping duty is imposed to protect local businesses and markets from unfair competition by foreign imports.
