


{"id":23024,"date":"2024-05-03T12:09:41","date_gmt":"2024-05-03T06:39:41","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=23024"},"modified":"2025-04-06T23:42:19","modified_gmt":"2025-04-06T18:12:19","slug":"standard-essential-patents-sep","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/standard-essential-patents-sep\/","title":{"rendered":"What are Standard Essential Patents (SEP)?"},"content":{"rendered":"<h2><strong>About Standard Essential Patents (SEP)<\/strong><\/h2>\n<ul>\n<li>A SEP is a patent <strong>granted for a technological invention<\/strong> which is <strong>essential for<\/strong> the implementation and <strong>working of a standard<\/strong>.<\/li>\n<\/ul>\n<h2><strong>What is a Standard?<\/strong><\/h2>\n<ul>\n<li>A \u2018standard\u2019 is a <strong>set of technical requirements<\/strong> or agreed <strong>technical descriptions<\/strong> which <strong>cover ideas, products, or services<\/strong> and <strong>make sure that technologies<\/strong> interact and <strong>work together.<\/strong><\/li>\n<li>Standards can be <strong>adopted worldwide<\/strong>, <strong>regionally<\/strong> or even nationally.<\/li>\n<li>It is usually in the interest of industrial players to create products that comply with standards.<\/li>\n<li>One <strong>example<\/strong> of a widely used standard is the <strong>A4 size for sheets of paper<\/strong>.<\/li>\n<li><strong>Patents which are essentialto a standard<\/strong> and have been <strong>adopted by a Standard Setting Organization<\/strong> (SSO) are <strong>known as SEPs.<\/strong><\/li>\n<li><strong>SSOs<\/strong> are either <strong>governmental, quasigovernmental,or a private<\/strong> group of independently governed industry associations.<\/li>\n<li><strong>SSOs set, develop,<\/strong> coordinate, interpret, and <strong>maintain standards.<\/strong><\/li>\n<li>Industry participants can collaborate on a single technical solution because of such standards.<\/li>\n<li><strong>When a patent is<\/strong> acknowledged by the SSO and <strong>designated as a SEP<\/strong>, <strong>manufacturers canonly produce their goods<\/strong> in the market <strong>after first acquiring a licenseunder the SEP.<\/strong><\/li>\n<li>From an antitrust standpoint, the <strong>lack of any competing technology<\/strong> g<strong>rants the SEP holder a monopolistic right<\/strong> over the SEP.<\/li>\n<li>Consequently, it is impossible to produce products that comply with standards without using technologies that are covered by one or more SEPs.<\/li>\n<li>SEPs are common in the mobile telephony and telecommunications industry, a sector which is highly standardised due mainly to the need for interoperability between mobile devices.<\/li>\n<\/ul>\n<hr \/>\n<h3><strong>Q1<\/strong>: What is a patent?<\/h3>\n<p>A patent is an exclusive right granted for an invention, which is a product or a process that provides, in general, a new way of doing something, or offers a new technical solution to a problem.
