


{"id":23635,"date":"2025-09-03T11:25:52","date_gmt":"2025-09-03T05:55:52","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=23635"},"modified":"2025-09-03T15:54:35","modified_gmt":"2025-09-03T10:24:35","slug":"foreigners-tribunal-ft","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/foreigners-tribunal-ft\/","title":{"rendered":"Foreigners Tribunal"},"content":{"rendered":"<h2><b>Foreigners Tribunal Latest News<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Union Ministry of Home Affairs (MHA) has given Foreigners Tribunals (FT), so far unique to Assam, the powers of a first class judicial magistrate.<\/span><\/p>\n<h2><b>About Foreigners Tribunal<\/b><\/h2>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">These are<\/span><b> quasi-judicial<\/b><span style=\"font-weight: 400;\"> bodies formed through the<\/span><b> Foreigners (Tribunals) Order of 1964 under Section 3 of the Foreigners\u2019 Act of 1946,<\/b><span style=\"font-weight: 400;\"> to <\/span><b>let local authorities <\/b><span style=\"font-weight: 400;\">in a State <\/span><b>refer a person suspected to be a foreigner to tribunals.<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Are FTs meant only for Assam?<\/b>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Foreigners (Tribunals) Order, 1964, <\/span><b>applies to the whole of Indi<\/b><span style=\"font-weight: 400;\">a,<\/span><b> yet FTs <\/b><span style=\"font-weight: 400;\">exist <\/span><b>only in Assam as of now.\u00a0<\/b><\/li>\n<li style=\"text-align: justify;\"><b>In other states,<\/b><span style=\"font-weight: 400;\"> if any<\/span><b> illegal immigrant<\/b><span style=\"font-weight: 400;\"> is found, he is <\/span><b>produced before a local court <\/b><span style=\"font-weight: 400;\">and dealt with as per the Foreigners Act, 1946.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><b>Prior to the 2019 amendment <\/b><span style=\"font-weight: 400;\">to the Foreigners (Tribunals) Order, 1964, <\/span><b>only the Centre <\/b><span style=\"font-weight: 400;\">was <\/span><b>empowered to establish FTs in states, <\/b><span style=\"font-weight: 400;\">but <\/span><b>after this amendment, t<\/b><span style=\"font-weight: 400;\">he <\/span><b>power has been<\/b> <b>granted to states as well.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"text-align: justify;\"><b>Composition<\/b><span style=\"font-weight: 400;\">: Each FT is <\/span><b>headed <\/b><span style=\"font-weight: 400;\">by a member <\/span><b>drawn from judges, advocates,<\/b><span style=\"font-weight: 400;\"> and <\/span><b>civil servants with judicial experience.<\/b><\/li>\n<li style=\"text-align: justify;\"><b>Powers<\/b><span style=\"font-weight: 400;\">: According to the 1964 order, an FT has the powers of a <\/span><b>civil court<\/b><span style=\"font-weight: 400;\"> in certain matters, such as summoning and enforcing the attendance of any person and examining him or her on oath and requiring the production of any document.<\/span><\/li>\n<\/ul>\n<h2><b>Foreigners Tribunal <\/b><b>Functioning<\/b><\/h2>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">A <\/span><b>tribunal <\/b><span style=\"font-weight: 400;\">is <\/span><b>required to serve a notice<\/b><span style=\"font-weight: 400;\"> in English or the official language of the State <\/span><b>to a person alleged to be a foreigner within 10 days <\/b><span style=\"font-weight: 400;\">of receiving the reference from the authority concerned.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">Such a <\/span><b>person has 10 days to reply t<\/b><span style=\"font-weight: 400;\">o the notice and a<\/span><b>nother 10 days to produce evidence <\/b><span style=\"font-weight: 400;\">in support of his or her case.<\/span><\/li>\n<li style=\"text-align: justify;\"><b>An FT has to dispose of a case within 60 days<\/b><span style=\"font-weight: 400;\"> of reference.\u00a0<\/span><\/li>\n<li style=\"text-align: justify;\"><b>If the person fails to provide any proof <\/b><span style=\"font-weight: 400;\">of citizenship, the<\/span><b> FT can send him<\/b><span style=\"font-weight: 400;\"> or her <\/span><b>to a detention centre, <\/b><span style=\"font-weight: 400;\">now called transit camp, for deportation later.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Immigration and Foreigners Order, 2025:<\/strong><\/h2>\n<ul>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The order is part of recently passed <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/immigration-and-foreigners-bill-2025\/\" target=\"_blank\"><b>Immigration and Foreigners Act, 2025<\/b><\/a><span style=\"font-weight: 400;\">. This order <\/span><b>replaces the Foreigners (Tribunal) Order, 1964<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It<\/span><b> allows FTs to issue arrest warrants and detain individuals who can&#8217;t prove they&#8217;re not foreigners. <\/b><span style=\"font-weight: 400;\">This was p<\/span><b>reviously done through executive orders.<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">It <\/span><b>empowers FTs to issue arrest warrants if a person<\/b><span style=\"font-weight: 400;\"> whose nationality is disputed <\/span><b>fails to appear in person.<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">FTs \u201cshall have the <\/span><b>powers of a civil court <\/b><span style=\"font-weight: 400;\">while trying a suit under the Code of Civil Procedure, 1908 (5 of 1908), and the <\/span><b>powers of a judicial magistrate of the first class under the Bharatiya Nagarik Suraksha Sahita, 2023,<\/b><span style=\"font-weight: 400;\"> (46 of 2023) in matters including-\u00a0<\/span>\n<ul>\n<li style=\"text-align: justify;\"><b>summoning and enforcing the attendance<\/b><span style=\"font-weight: 400;\"> of any person and <\/span><b>examining him on oath;<\/b><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">\u00a0requiring the <\/span><b>discovery and production of any document;<\/b><\/li>\n<li style=\"text-align: justify;\"><b>issuing commissions <\/b><span style=\"font-weight: 400;\">for the examination of any witness;<\/span><\/li>\n<li style=\"text-align: justify;\"><span style=\"font-weight: 400;\">directing the proceedee to appear before it in person;<\/span><\/li>\n<li style=\"text-align: justify;\"><b>issuing a warrant of arrest <\/b><span style=\"font-weight: 400;\">against the proceedee, if he fails to appear before it.\u201d<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p><b>Source<\/b><span style=\"font-weight: 400;\">: <\/span><a href=\"https:\/\/www.thehindu.com\/news\/national\/foreigners-tribunals-can-issue-arrest-warrants-send-people-to-detention-centres\/article70005218.ece\" target=\"_blank\" rel=\"nofollow noopener\"><span style=\"font-weight: 400;\">TH<\/span><\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Foreigners Tribunals  are quasi-judicial bodies formed through the Foreigners (Tribunals) Order of 1964 under Section 3 of the Foreigners\u2019 Act of 1946, to let local authorities in a State refer a person suspected to be a foreigner to tribunals.
