text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is a <\/span><b>common law doctrin<\/b><span style=\"font-weight: 400;\">e founded on the principle of <\/span><b>maintenance of decorum and propriety in the functioning of Courts and <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/tribunals\/\" target=\"_blank\">Tribunals<\/a><\/b><span style=\"font-weight: 400;\"> and preserving the sanctity of the justice delivery system.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The underlying logic being that <\/span><b>there cannot be more than one decree <\/b><span style=\"font-weight: 400;\">or operative <\/span><b>order governing the same subject matter at a given point of time.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It provides that <\/span><b>when an appellate court passes an order<\/b><span style=\"font-weight: 400;\">, the <\/span><b>order passed by the lower court is merged with that order.<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The doctrine is <\/span><b>not recognized statutorily<\/b><span style=\"font-weight: 400;\"> but is a <\/span><b>statement of judicial propriety <\/b><span style=\"font-weight: 400;\">and <\/span><b>seeks to instill discipline <\/b><span style=\"font-weight: 400;\">in the functioning of subordinate adjudicating authorities, whether judicial, quasi-judicial, or administrative.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>applicability of the doctrine of merger entails <\/b><span style=\"font-weight: 400;\">the <\/span><b>existence of a decision of a subordinate court<\/b><span style=\"font-weight: 400;\">\/forum <\/span><b>against which a right of appeal\/<\/b><span style=\"font-weight: 400;\">revision <\/span><b>before a superior forum\/authority exists<\/b><span style=\"font-weight: 400;\">, <\/span><b>which has been exercised<\/b><span style=\"font-weight: 400;\"> and which has <\/span><b>either modified, reversed or affirmed the decision of the subordinate authority.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The consequence of such an act would be that the<\/span><b> decision of the subordinate authority shall merge with that of the superior forum<\/b><span style=\"font-weight: 400;\">, which only shall sustain, be operative and capable of being enforced.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The essence of the doctrine of merger is that it is only the decisions of the appellate, revisional, or higher authority that subsist, and the order under challenge ceases to have an independent existence.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The doctrine <\/span><b>solves the issue of which order must be enforced <\/b><span style=\"font-weight: 400;\">and given importance if there are multiple orders passed by both subordinate and superior courts on a single issue.<\/span><\/li>\n<li style=\"font-weight: 400;
