


{"id":24423,"date":"2024-06-23T07:38:35","date_gmt":"2024-06-23T02:08:35","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=24423"},"modified":"2025-04-07T09:26:01","modified_gmt":"2025-04-07T03:56:01","slug":"what-is-the-goods-and-services-tax-council","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-the-goods-and-services-tax-council\/","title":{"rendered":"What is the Goods and Services Tax Council?"},"content":{"rendered":"<h2><strong>About GST Council:<\/strong><\/h2>\n<ul>\n<li>It is a <strong>constitutional body<\/strong> responsible for <strong>making recommendations<\/strong> on issues related to the <strong>implementation of <\/strong>the Goods and Services Tax (<strong>GST) in India<\/strong>.\u00a0<\/li>\n<li><strong>Article 279A<\/strong> of the Indian Constitution gives power to the<strong> President of India<\/strong> to<strong> constitute <\/strong>a joint forum of the Centre and States called the <strong>GST Council, consisting of:<\/strong>\n<ul>\n<li><strong>Union Finance Minister as Chairperson<\/strong><\/li>\n<li>The <strong>Union Minister of State<\/strong>, in-<strong>charge of Revenue of finance<\/strong><\/li>\n<li>The <strong>Minister in-charge of finance or taxation, or any other Minister nominated by each State<\/strong> Government<\/li>\n<\/ul>\n<\/li>\n<li>It is an apex committee to modify, reconcile, or mak<strong>e recommendations to the Union and the States on important issues related to GST<\/strong>, like the goods and services that may be subjected to or exempted from GST, model GST Laws, principles that govern Place of Supply, threshold limits, GST rates including the floor rates with bands, special rates for raising additional resources during natural calamities\/disasters, special provisions for certain States, etc.<\/li>\n<li><strong>Decisions<\/strong> in the GST Council <strong>are taken during its meetings<\/strong>.\n<ul>\n<li><strong>One half <\/strong>of the total number of members of the GST Council shall <strong>constitute the quorum<\/strong> at its meeting.<\/li>\n<li><strong>Each decision<\/strong> of the council <strong>must be supported by<\/strong> a majority of <strong>not less than three-fourth of weighted votes<\/strong> of the <strong>members present and voting<\/strong>.<\/li>\n<li>The <strong>vote of the Central Government<\/strong> shall <strong>have a weightage of 1\/3rd<\/strong> of the votes cast, and the votes <strong>of all the State Governments<\/strong> taken together shall have a <strong>weightage of 2\/3rd of the total votes cast<\/strong> in that meeting.\u00a0<\/li>\n<\/ul>\n<\/li>\n<li><strong>Secretariat:<\/strong>\n<ul>\n<li>The Secretariat <strong>manages the GST Council.<\/strong><\/li>\n<li>It is manned by officers taken on deputation from both the Central and State Governments.<\/li>\n<li>The <strong>entire cost<\/strong> of managing the Secretariat is <strong>borne by the Central Government.<\/strong><\/li>\n<li>The <strong>Ex-officio Secretary to the GST Council<\/strong> is the <strong>Revenue Secretary of India.<\/strong><\/li>\n<li>The office of the council is located in <strong>New Delhi.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><strong>What is the Goods and Services Tax (GST)?<\/strong><\/h2>\n<ul>\n<li>It is an <strong>indirect tax<\/strong> which has <strong>replaced many indirect taxes in India,<\/strong> such as excise duty, VAT, services tax, etc.<\/li>\n<li>The GST Act was passed in Parliament on 29th March 2017 and <strong>came into effect on 1st July, 2017.<\/strong><\/li>\n<li>It is a <strong>single domestic indirect tax law<\/strong> for the entire country.<\/li>\n<li>It is a comprehensive, <strong>multi-stage, destination-based tax<\/strong> that is <strong>levied on the supply of goods and services<\/strong>, right from the manufacturer to the consumer.\u00a0<\/li>\n<li>Under the GST regime, the <strong>tax is levied at every point of sale<\/strong>.\n<ul>\n<li>In the case of intrastate sales, Central GST and State GST are charged.<\/li>\n<li>All the interstate sales are chargeable to the Integrated GST.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Credits of input taxes paid<\/strong> at each stage <strong>will be available in the subsequent stage<\/strong> of value addition, which makes GST essentially a <strong>tax only on value addition at each stage<\/strong>.<\/li>\n<li>The <strong>final consumer<\/strong> will thus <strong>bear only the GST charged by the last dealer<\/strong> in the supply chain, with set-off benefits at all the previous stages.<\/li>\n<li>The GST is <strong>paid by consumers<\/strong>, but it is <strong>remitted to the government by the businesses<\/strong> selling the goods and services.<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1: What is an Indirect Tax?<\/h3>\n<p>An indirect tax is collected by one entity in the supply chain, such as a manufacturer or retailer, and paid to the government; however, the tax is passed onto the consumer by the manufacturer or retailer as part of the purchase price of a good or service.
