


{"id":26005,"date":"2024-08-23T12:37:15","date_gmt":"2024-08-23T07:07:15","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=26005"},"modified":"2025-04-07T22:56:32","modified_gmt":"2025-04-07T17:26:32","slug":"what-is-the-joint-consultative-machinery","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-the-joint-consultative-machinery\/","title":{"rendered":"What is the Joint Consultative Machinery (JCM)?"},"content":{"rendered":"<h2><strong>About Joint Consultative Machinery (JCM):<\/strong><\/h2>\n<ul>\n<li>It is a <strong>platform for constructive dialogue between<\/strong> the representatives of <strong>the staff side and the official side<\/strong> for peaceful <strong>resolution of all disputes between<\/strong> the <strong>Government asemployer and the employees.<\/strong><\/li>\n<li>The scheme was introduced in 1966 with the objectives of promoting harmonious relations and securing the greatest measure of cooperation between the Central Government as the employer and the employees.<\/li>\n<li>The scheme is a <strong>non-statutory one mutually agreed<\/strong> upon <strong>between the staff sideandthe official side.<\/strong><\/li>\n<li>The scheme <strong>covers all regular civil employees of<\/strong> the <strong>Central Government, except:<\/strong>\n<ul>\n<li>The <strong>Class-I services<\/strong>;<\/li>\n<li>The <strong>Class-II services<\/strong>, other than the Central Secretariat Services and the other comparable services in the headquarters organization of the Government;<\/li>\n<li><strong>Persons in industrial establishments<\/strong> employed mainly <strong>in managerial or administrative capacity<\/strong>, and those who are being employed in supervisory capacity drawing salary going beyond grade pay of Rs.4200\/- per month;<\/li>\n<li><strong>Employees of<\/strong> the <strong>Union Territories;<\/strong><\/li>\n<li><strong>Police personnel.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2><strong>Joint Councils:<\/strong><\/h2>\n<ul>\n<li>The scheme provides for the setting up of <strong>joint councils at<\/strong> the <strong>National, Departmental and Regional \/ Office levels.<\/strong><\/li>\n<li>The <strong>National Council<\/strong>, <strong>chaired by<\/strong> the <strong>Cabinet Secretary<\/strong>, is the <strong>apex body.<\/strong><\/li>\n<li>The <strong>scope<\/strong> of the Joint Councils <strong>includes all mattersrelatingto conditions of service and work<\/strong>, <strong>welfare<\/strong> of employees, and improvement of efficiency and <strong>standards of work<\/strong>, <strong>provided<\/strong>, however, that\n<ul>\n<li>in regard to matters of recruitment, promotion, and discipline, consultation is limited to matters of general principles only, and<\/li>\n<li><strong>individual cases are not considered<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>The National Councildeals<\/strong> only with <strong>matters affecting Central Government employee<\/strong>s generally, such as pay of common categories of staff, allowances, etc.,<\/li>\n<li>The <strong>Departmental Councildeals<\/strong> with matters affecting only the<strong> employeesin<\/strong> the <strong>Ministries\/Departments<\/strong> concerned.<\/li>\n<li>The <strong>Office\/Regional Councils<\/strong> deal with regional or <strong>local issues only.<\/strong><\/li>\n<\/ul>\n<hr \/>\n<h3><strong>Q1<\/strong>: What is the Central Administrative Tribunal (CAT)?<\/h3>\n<p>The CAT had been established under Article 323-A of the Constitution to adjudicate disputes and complaints with respect to the recruitment and conditions of service of persons appointed to public services and posts in connection with the affairs of the Union or other authorities under the control of the Government. In addition to the Ministries and Departments of Central Government, the Government has notified about 214 organizations under Section 14(2) of the Administrative Tribunals Act, 1985, to bring them within the jurisdiction of the CAT from time to time.
