{"id":26119,"date":"2024-08-27T02:21:06","date_gmt":"2024-08-26T20:51:06","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=26119"},"modified":"2025-04-07T23:48:01","modified_gmt":"2025-04-07T18:18:01","slug":"plea-bargaining","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/plea-bargaining\/","title":{"rendered":"What is Plea Bargaining?"},"content":{"rendered":"<h2><strong>About Plea Bargaining:<\/strong><\/h2>\n<ul>\n<li>Plea bargaining is a process in which a <strong>defendant in a criminal case agrees to plead guilty in exchange for some concession from<\/strong> the prosecutor or <strong>the court.<\/strong>\n<ul>\n<li>The <strong>concession could be <\/strong>a <strong>reduced sentence, <\/strong>a <strong>lesser charge<\/strong>, dropping some charges, or <strong>any other agreement<\/strong> that benefits the defendant.<\/li>\n<\/ul>\n<\/li>\n<li>The <strong>aim<\/strong> of plea bargaining is to <strong>resolve a criminal case without going to trial<\/strong>, thereby <strong>saving time, resources<\/strong>, and expenses for both the prosecution and the defendant.\u00a0<\/li>\n<li><strong>Plea Bargaining in India:<\/strong>\n<ul>\n<li>In India, plea bargaining is <strong>governed by the Code of Criminal Procedure, 1973,<\/strong> which incorporated it in 2005.<\/li>\n<li>Under the Indian legal system, plea bargaining is <strong>available for offenses<\/strong> that are <strong>punishable with imprisonment for<\/strong> a <strong>term of seven years or less.<\/strong><\/li>\n<li>The <strong>accused person must voluntarily opt for plea bargaining<\/strong>, and the <strong>court must be satisfied<\/strong> that the <strong>plea has been made voluntarily<\/strong> and with full knowledge of its consequences.<\/li>\n<li>Plea bargaining <strong>can take place at any stage of<\/strong> the <strong>criminal justice process<\/strong>, from the initial charge to the trial itself.<\/li>\n<li>The process of plea bargaining in India is <strong>initiated by the accused by filing an application before the court<\/strong> expressing his willingness to plead guilty.<\/li>\n<li>The <strong>court will<\/strong> then <strong>examine the application<\/strong> and may <strong>allow or reject it<\/strong> based on the facts and circumstances of the case.<\/li>\n<li><strong>If the court allows<\/strong> the application, it will <strong>refer the matter to the prosecutor for<\/strong> further <strong>negotiations<\/strong>.<\/li>\n<li><strong>During the negotiation<\/strong> process, the <strong>prosecutor may offer a reduced sentence<\/strong> or some other concession <strong>in exchange for the accused&#8217;s guilty plea<\/strong>.<\/li>\n<li>The <strong>accused may accept or reject the offer<\/strong>, and <strong>if accepted<\/strong>, the <strong>court will record the plea of guilt<\/strong> and <strong>pronounce the sentence<\/strong> as per the terms of the plea-bargaining agreement.<\/li>\n<li>The <strong>court has the discretion to accept or reject the plea-bargaining agreement<\/strong> if it deems it to be unjust, unreasonable, or contrary to the interest of justice.<\/li>\n<li>Additionally, <strong>if the accused breaches the terms<\/strong> of the plea-bargaining agreement, the <strong>court may set aside the agreement<\/strong> and <strong>proceed with the trial.<\/strong><\/li>\n<li>The <strong>accused has the right to withdraw the plea at any time before<\/strong> the <strong>court pronounces the sentence<\/strong>.
