


{"id":27420,"date":"2024-10-21T08:16:10","date_gmt":"2024-10-21T02:46:10","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=27420"},"modified":"2025-10-13T11:10:22","modified_gmt":"2025-10-13T05:40:22","slug":"prohibition-of-child-marriage-act-pcma-2006","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/prohibition-of-child-marriage-act-pcma-2006\/","title":{"rendered":"Prohibition of Child Marriage Act (PCMA), 2006"},"content":{"rendered":"<h2><strong>About Prohibition of Child Marriage Act (PCMA):<\/strong><\/h2>\n<ul>\n<li>PCMA came into force in 2006 to <strong>prevent child marriage<\/strong> and ensure the eradication of the practice.\u00a0<\/li>\n<li>It <strong>replaced the Child Marriage Restraint Act of 1929<\/strong>.<\/li>\n<li>The primary object of the Act is <strong>to prohibit solemnization of child marriage<\/strong>.<\/li>\n<li>This Act is armed with enabling <strong>provisions to prohibit child marriages<\/strong>, <strong>provide relief to victims, <\/strong>and <strong>enhance punishment<\/strong> for those who abet, promote, or solemnize such marriages.\u00a0<\/li>\n<li>As per the act, the <strong>age of marriage for boysis 21<\/strong>, and <strong>for girls, it is 18,<\/strong> and <strong>any marriage of people below this<\/strong> age will be considered a child marriage which <strong>is illegal,<\/strong> an offence, and is <strong>punishable<\/strong> under the law.<\/li>\n<li><strong>Any person can report an incidence of child marriage<\/strong> before or after it has been solemnized.<\/li>\n<li><strong>Nodal Officer<\/strong>:\n<ul>\n<li><strong>The District Collector<\/strong> is the Nodal Officer at the district level for the purpose of implementation of the Act.<\/li>\n<li>He\/she shall periodically review the implementation of the Act within the respective district and take all necessary measures for the proper and effective implementation of the Act.<\/li>\n<\/ul>\n<\/li>\n<li><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/child-marriage-in-india\/\" target=\"_blank\"><strong>Child Marriage<\/strong><\/a><strong> Prohibition Officers (CMPO)<\/strong> are to be appointed <strong>in every state<\/strong> to prohibit child marriages and ensure the <strong>protection of the victims<\/strong> as well as <strong>prosecution of the offenders.\u00a0<\/strong><\/li>\n<li>The <strong>CMPO<\/strong> has been empowered to <strong>provide necessary legal aid to victims<\/strong> of child marriage and to <strong>produce children in need of care <\/strong>and protection<strong> before the Child Welfare Committee<\/strong> or a First-Class Judicial Magistrate, where there is no Child Welfare Committee.<\/li>\n<li><strong>Petition<\/strong>:\n<ul>\n<li>The petition to nullify the child marriage can be made in court <strong>only by the girl or boy<\/strong>, who are <strong>below 18 years of a geat the time of marriage<\/strong>.<\/li>\n<li>However, <strong>a guardian along with the CMPO can file<\/strong> the annulment petition on behalf of the child, if <strong>they are still minors<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>The <strong>District Court can grant nullity of marriage<\/strong>. The District Court includes the Family Court, the Principal Civil Court of Original Jurisdiction, and any other civil court specified by the State Government.<\/li>\n<li><strong>Punishments:<\/strong>\n<ul>\n<li>Child marriage is an offence punishable with hard <strong>imprisonment ,or with fine<\/strong> or both.<\/li>\n<li>The courts <strong>can issue injunctions prohibiting solemnization of child marriages<\/strong>.<\/li>\n<li>The offences under the Act are <strong>cognizable and non-bailable.\u00a0<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Protection<\/strong>:\n<ul>\n<li>The law provides for all support and aid, including <strong>medical aid, legal aid, counselling,<\/strong> and <strong>rehabilitation support <\/strong>for children once they are rescued.<\/li>\n<li>It <strong>gives legal status to<\/strong> all <strong>children born from child marriages<\/strong> and makes provisions for their custody and maintenance.<\/li>\n<li>It provides for the <strong>residence and maintenance of the female <\/strong>contracting party.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3><strong>Q1<\/strong>: What is a cognizable offence?<\/h3>\n<p>Cognizable offence means an offence for which, and cognizable case means, a case in which a police officer may, in accordance with the First Schedule or under any other law for the time bell in force, arrest without warrant.
