Why Is It Needed?"},"content":{"rendered":"<h3><strong>What\u2019s in today\u2019s article:<\/strong><\/h3>\n<ul>\n<li><strong>Background (About PCA Act, 1960)<\/strong><\/li>\n<li><strong>Amendment to PCA Act (Need, Various proposals, Government\u2019s response, Provisions)<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Why In News:<\/strong><\/h2>\n<ul>\n<li>A draft\u00a0<strong>Prevention of Cruelty to Animals (Amendment) Bill, 2022<\/strong>, prepared by the Ministry of Fisheries, Animal Husbandry, and Dairying, has been opened for public comments until December 7, 2022.<\/li>\n<li>Once the draft is final, the Bill could be brought either in the Winter Session or the Budget Session of Parliament.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Background:<\/strong><\/h2>\n<ul>\n<li>The Prevention of Cruelty to Animal Act, 1960 is one of the most comprehensive laws on the subject of animal welfare in India.\n<ul>\n<li>The Act was authored by acclaimed dancer and animal lover,\u00a0<strong>Rukmini Devi Arundale<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>It is an Act of the Parliament passed in December 1960 with a vision\u00a0<strong>to prevent cruelties on animals<\/strong>.<\/li>\n<li>The Act enshrines provisions for establishing the\u00a0<strong>Animal Welfare Board of India<\/strong>, its powers, functions, constitution, and term of the office of members of the Board.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>What is the need for amending the existing law?<\/strong><\/h2>\n<ul>\n<li>In September, a doctor in Rajasthan\u2019s Jodhpur allegedly tied a dog to his car and dragged it across the city. The dog had a fractured leg and suffered bruises.<\/li>\n<li>An offence such as this \u2014 fairly common in India \u2014 would currently attract charges under Section 428 (mischief by killing or maiming animal) IPC and Section 11 (treating animals cruelly) of The PCA Act, 1960.<\/li>\n<li>First-time offenders under the PCA Act are punished with a fine of Rs 10-50.\n<ul>\n<li>If it is found that this is not the offender\u2019s first such crime in the past three years, the maximum punishment would be a fine between Rs 25 and Rs 100, a jail term of three months, or both.<\/li>\n<\/ul>\n<\/li>\n<li>In short, the\u00a0<strong>penalty is very light in the law as it exists now, and is incapable of acting as any deterrent for potential offenders<\/strong>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Who has called for amendments and on what grounds?<\/strong><\/h2>\n<ul>\n<li>In 2014, the Supreme Court, in \u2018<strong>Animal Welfare Board of India vs A Nagaraja &amp; Others<\/strong>\u2019, had said that \u201cParliament is expected to make proper amendment of the PCA Act to provide an effective deterrent\u201d and that \u201cfor violation of Section 11, adequate penalties and punishments should be imposed\u201d.<\/li>\n<li>In September 2020, Kishanganj MP Mohammad Jawed brought a Bill in Parliament saying that the maximum punishment be hiked.<\/li>\n<li>In 2021, Kendrapara MP Anubhav Mohanty also proposed a Bill,\u00a0<u>expanding the definition of cruelty to include events where \u201canimals are subjected to cruelty either during the sport or activity itself\u201d<\/u>.<\/li>\n<li>In 2020, a group of MPs cutting across party lines wrote to then Animal Husbandry Minister Giriraj Singh, urging that the\u00a0<u>punishment in the 1960 Act be increased<\/u>.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Union Government\u2019s response:<\/strong><\/h2>\n<ul>\n<li>In October 2021, the\u00a0<u>government said it would bring in a Bill to amend the PCA Act<\/u>.<\/li>\n<li>Union Minister for Animal Husbandry Parshottam Rupala said \u201cWe are ready with the draft amendment Bill.
