


{"id":3479,"date":"2023-03-01T05:23:05","date_gmt":"2023-02-28T23:53:05","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=3479"},"modified":"2025-03-26T12:39:23","modified_gmt":"2025-03-26T07:09:23","slug":"what-is-the-anti-defection-law","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-the-anti-defection-law\/","title":{"rendered":"What is the Anti-defection law?"},"content":{"rendered":"<h2><strong>About Anti-defection law :<\/strong><\/h2>\n<ul>\n<li>It was <strong>introduced<\/strong> in India <strong>in 1985<\/strong> through the <strong>52nd amendment<\/strong> to the Constitution of India.<\/li>\n<li>This amendment <strong>added the Tenth Schedule to the Constitution<\/strong>, which lists out the <strong>provisions related to defection<\/strong>.<\/li>\n<li>It <strong>lays down the process by which legislators may be disqualified<\/strong> on grounds of defection <strong>by the Presiding Officer<\/strong> of a legislature <strong>based on a petition by any other member of the House.<\/strong><\/li>\n<li>This schedule applies<strong> to both Central and State legislature.<\/strong><\/li>\n<li><strong>Aim<\/strong>: The main aim of this schedule was <strong>to prevent political defections<\/strong> and to strengthen democracy by <strong>bringing stability in politics<\/strong> and make members of parliament more responsible and loyal to their parties.<\/li>\n<li><strong>Grounds of disqualification: <\/strong>A member of any state or central legislature can be disqualified from being a member if,\n<ul>\n<li><strong>He voluntarily gives up his membership of a political party.<\/strong><\/li>\n<li><strong>He disobeys the directions<\/strong> of his political party <strong>or votes or does not vote in the legislature contrary to the directions of his <\/strong>political <strong>party.<\/strong><\/li>\n<li><strong>After the election, he joins another political party.<\/strong><\/li>\n<li>If a <strong>nominated member joins any political party after 6 months<\/strong> from the day, <strong>he becomes a member of the legislature<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Exemptions:<\/strong>\n<ul>\n<li>Disqualification of a member is <strong>not applied in case of a merger,<\/strong> <strong>provided<\/strong> that this merger with or into another party <strong>shall be done with the consent of at least two-thirds of its legislator<\/strong>s. In such a scenario, <strong>neither the members who decide to merge nor the ones who stay<\/strong> with the original party <strong>will face disqualification<\/strong>.<\/li>\n<li>It exempts<strong> the speaker, chairman, and deputy chairman<\/strong> of various legislative houses from disqualification on the ground of defection.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Deciding authority:<\/strong>\n<ul>\n<li>The decision to disqualify a member under the anti-defection law is <strong>taken by the presiding officer of the house. ( Speaker or Chairman accordingly).<\/strong><\/li>\n<li>The law <strong>does not specify a time period<\/strong> for the Presiding Officer <strong>to decide on a disqualification plea.<\/strong><\/li>\n<li><strong>The decisions<\/strong> of the Speaker or Chairman in anti-defection cases <strong>are subject to judicial review.<\/strong><\/li>\n<li>However, there <strong>can not be any judicial intervention until the Presiding Officer gives his order.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1)\u00a0What is a Floor test?<\/h3>\n<p>A floor test is a measure to check whether the executive is enjoying the confidence of the legislature.
