


{"id":34966,"date":"2023-04-15T05:16:34","date_gmt":"2023-04-14T23:46:34","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=34966"},"modified":"2025-04-20T20:19:22","modified_gmt":"2025-04-20T14:49:22","slug":"the-maternity-benefit-act","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/the-maternity-benefit-act\/","title":{"rendered":"The Maternity Benefit Act"},"content":{"rendered":"<h3><strong>What\u2019s in today\u2019s article?<\/strong><\/h3>\n<ul>\n<li><strong>Why in News?<\/strong><\/li>\n<li><strong>What is the Maternity Benefit Act 1961?<\/strong><\/li>\n<li><strong>The Maternity Benefits (Amendment) Act 2017<\/strong><\/li>\n<li><strong>What are the Criticisms of the Amended Act?<\/strong><\/li>\n<li><strong>News Summary Regarding Petition Challenging the Maternity Benefit Act<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Why in News?<\/strong><\/h2>\n<ul>\n<li>The Supreme Court agreed to hear a petition challenging the constitutional validity of <strong>Section 5(4) of the Maternity Benefit Act 1961<\/strong>, which states that a woman who legally adopts a child <strong>below three months<\/strong> old will be entitled to 12 weeks of maternity leave.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<h2><strong>What is the Maternity Benefit Act 1961?<\/strong><\/h2>\n<ul>\n<li>It was originally passed <strong>to regulate the employment of women<\/strong> in \u201ccertain establishments\u201d for the period <strong>before and after childbirth<\/strong> and to provide for maternity benefit and certain other benefits.<\/li>\n<li>Originally, it applied<strong> to every establishment<\/strong> being a factory, mine or plantation.<\/li>\n<li>In 1973, it was extended to \u201c<strong>any such establishment belonging to the Government<\/strong>\u201d and \u201cevery establishment where persons are employed for the exhibition of equestrian, acrobatic and other performances.\u201d<\/li>\n<li><strong>No employer shall knowingly employ a woman<\/strong> in any establishment during the <strong>six weeks immediately following<\/strong> the day of her delivery or her miscarriage.<\/li>\n<li><strong>The right to paid maternity leaves<\/strong> was also given, although the period of such leave could not exceed twelve weeks.<\/li>\n<li><strong>For availing maternity benefits<\/strong>, a woman is mandated to work in the establishment for at least 160 days in the 12 months immediately preceding the date of her expected delivery.<\/li>\n<li>Violating provisions of the Act could result in <strong>3 months\u2019 punishment<\/strong>, with or without a fine<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>The Maternity Benefits (Amendment) Act 2017:<\/strong><\/h2>\n<ul>\n<li>It amended Section 5 of the erstwhile Act <strong>to allow 26 weeks of paid leave after childbirth<\/strong>, although <strong>only to biological mothers<\/strong>.<\/li>\n<li>The amendment inserted <strong>Section 5(4)<\/strong> which said that adoptive or surrogate mothers legally adopting a child below three months will be entitled to a maternity benefit period of <strong>12 weeks<\/strong> from the date the child is handed over to the mother.<\/li>\n<li>Further, it inserted provisions<strong> to allow women to work from home under Section 5(5)<\/strong>, where the nature of work assigned to a woman is of such nature.\n<ul>\n<li>The employer may allow her to do so after availing of the maternity benefit for such a period.<\/li>\n<\/ul>\n<\/li>\n<li>Under the amended Act, <strong>every establishment having fifty or more employees<\/strong> shall have the facility of <strong>creche <\/strong>and the employer must allow four visits a day to the creche as well as rest intervals for her.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>What are the Criticisms of the Amended Act?<\/strong><\/h2>\n<ul>\n<li>Women in the <strong>unorganised <\/strong>sector cannot avail maternity benefits.<\/li>\n<li>Even five years after the amendment Act was passed, it was <strong>yet to deliver a positive impact on job opportunities for women<\/strong>.<\/li>\n<li><strong>The women\u2019s participation dropped <\/strong>in more than five out of 10 sectors (surveyed by a human resource organisation) since the implementation of the Act.<\/li>\n<li>After maternity, <strong>women face several challenges <\/strong>&#8211; 30% cited wage cuts followed by resistance or lack of support from family and access to childcare.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>News Summary Regarding Petition Challenging the Maternity Benefit Act:<\/strong><\/h2>\n<ul>\n<li>According to Section 5(4) of the amended Act, the term \u201c<strong>commissioning mother<\/strong>\u201d refers to a surrogate mother and has been defined as <strong>a biological mother who uses her egg to create an embryo implanted in any other woman<\/strong>.<\/li>\n<li>A woman adopting a child <u>older than three months<\/u> gets <strong>no benefits.<\/strong><\/li>\n<li>A Public Interest Litigation (PIL) was filed challenging Section 5(4) of the Act on grounds of being <strong>\u201cdiscriminatory\u201d and \u201carbitrary&#8221;
