The State of Rajasthan (1997):<\/strong>\n<ul>\n<li>The SC issued the<strong> Vishaka Guidelines<\/strong>, with the primary objective of providing a mechanism for workplace sexual misconduct redress and grievance processes.<\/li>\n<li>These recommendations inspired the PoSH Act &#8211; a law administered by the Union <strong>Ministry of Women &amp; Child Development (MoWCD).<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Objective of the PoSH Act:<\/strong>\n<ul>\n<li>It aims to protect the <strong>rights of women<\/strong> at work and to<strong> make the workplace a safer place<\/strong> for them.\\<\/li>\n<li>The legislation also functions as a forum for<strong> both avoiding and addressing problems.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Provisions of the Act:<\/strong>\n<ul>\n<li><strong>Defines sexual harassment at workplace:<\/strong> Unwanted sexual physical, verbal or nonverbal action is defined as physical contact and advances, demand or desire for sexual favours, making sexually tinged comments, showing pornography, etc.<\/li>\n<li><strong>The concept of \u201cextended workplace\u201d:<\/strong> It defines \u201cworkplace\u201d as any site where an employee goes as a consequence of work, including transportation offered by the organisation for the purpose of travel.<\/li>\n<li><strong>Committees for complaints:<\/strong>\n<ul>\n<li>The most prominent feature of the Act is that it mandates any corporation or organisation <strong>with more than 10 employees<\/strong> to establish an <strong>Internal Complaint Committee (ICC) <\/strong>to hear and address sexual harassment allegations.<\/li>\n<li>The MoWCD introduced (in 2017) an online platform &#8211; <strong>SHe-Box<\/strong> &#8211; that directs complaints to the employer or organisation\u2019s ICC.<\/li>\n<li>The Act mandates the District Officer to organise a <strong>Local Complaint Committee <\/strong>in each district where there are <strong>less than 10 workers.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Duties and obligations of employer:<\/strong>\n<ul>\n<li>It is a <strong>legal need <\/strong>to handle sexual harassment as a violation of service regulations.<\/li>\n<li>If the employer fails to comply with the regulations a penalty of Rs. 50000 or it can even lead to cancellation of licence.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<figure class=\"media\">\n<div data-oembed-url=\"https:\/\/www.youtube.com\/watch?v=fA6PblYFztk\">\n<div><iframe src=\"https:\/\/www.youtube.com\/embed\/fA6PblYFztk\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><\/iframe><\/div>\n<\/div>\n<\/figure>\n<p>&nbsp;<\/p>\n<h2><strong>Procedure for Complaint Against Sexual Harassment at the Workplace:<\/strong><\/h2>\n<ul>\n<li>An aggrieved female <strong>has three months<\/strong> from the date of the tragedy to make a written complaint with the ICC.\n<ul>\n<li>According to the SC, the time limit can be extended if the lady is unable to submit the complaint owing to mitigating circumstances.<\/li>\n<\/ul>\n<\/li>\n<li>Before initiating an investigation, the committee can try to resolve the matter through <strong>mediation <\/strong>between the women and the responder.\n<ul>\n<li>If a settlement is reached,<strong> no further investigation will be launched<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>If the proposed conciliation does not provide any results, a<strong> fresh investigation<\/strong> (to be concluded in 90 days) will be launched.\n<ul>\n<li>While directing the investigation, the Committee has the same authority as a <strong>civil court<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li>If the ICC determines that the claim against the defendant is <strong>false<\/strong>, the<strong> woman may be fired.<\/strong><\/li>\n<li>If the complaint is <strong>proven<\/strong>, the committee will recommend to the District Officer that sexual harassment be considered as improper conduct in accordance with the Act and the victim woman should be <strong>compensated<\/strong>.<\/li>\n<li>Any individual who is harmed by the ICC guidelines, <strong>may file an appeal<\/strong> with the court (HC) within 90 days of their implementation.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>News Summary Regarding SC\u2019s Directions on the Effective Implementation of the POSH Act:<\/strong><\/h2>\n<ul>\n<li><strong>Background:<\/strong>\n<ul>\n<li>The apex court was deciding<strong> an appeal against the Bombay HC<\/strong> order upholding an employee\u2019s dismissal from service on sexual harassment charges.<\/li>\n<li>Allowing the appeal and sending the matter back to the Complaints Committee, the court flagged a report that <strong>16 of the 30 national sports federations <\/strong>(including wrestling) <strong>don\u2019t have an ICC as stipulated under PoSH.<\/strong><\/li>\n<li>This is <strong>indeed a sorry state of affairs and reflects poorly on all the state functionaries<\/strong>.<\/li>\n<li>Being a victim of such a deplorable act not only dents the<strong> self-esteem of a woman, <\/strong>it also takes a toll on her <strong>emotional, mental and physical health<\/strong>.<\/li>\n<li>Many of them are reluctant to report such misconduct and even \u201c<strong>drop out from their job<\/strong>.\u201d<\/li>\n<li>There is the \u201c<strong>uncertainty<\/strong>\u201d over who to approach under the Act and the \u201c<strong>lack of confidence in the process and its outcome<\/strong>.\u201d<\/li>\n<\/ul>\n<\/li>\n<li><strong>The court issued some key directions to the Centre, states and UTs:<\/strong>\n<ul>\n<li><strong>To undertake a time-bound exercise<\/strong> to verify whether all Ministries, Departments, Government organisations, authorities, Public Sector Undertakings, institutions, bodies, <strong>have<\/strong> ICCs.<\/li>\n<li><strong>The information regarding the constitution and composition<\/strong> of these committees are to be made readily available on the website of the concerned authority.<\/li>\n<li><strong>Immediate and effective steps by the authorities <\/strong>to \u201cfamiliarise\u201d committee members with their duties and the manner in which an inquiry ought to be conducted.<\/li>\n<li>The bench directed the <strong>National Legal Services Authority and State Legal Services Authorities<\/strong> to organise awareness programmes to sensitise employers, employees
