


{"id":3650,"date":"2023-03-03T04:57:09","date_gmt":"2023-03-02T23:27:09","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=3650"},"modified":"2025-03-26T16:59:23","modified_gmt":"2025-03-26T11:29:23","slug":"how-are-the-cec-and-ecs-appointed","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/how-are-the-cec-and-ecs-appointed\/","title":{"rendered":"How are the CEC and ECs appointed?"},"content":{"rendered":"<h2><strong>About Election Commission of India (ECI):<\/strong><\/h2>\n<ul>\n<li>It is an <strong>autonomous and permanent constitutional body<\/strong> responsible <strong>for organizing free and fair elections in India.<\/strong><\/li>\n<li>The Constitution grants the ECI with the power of direction, superintendence, and control of <strong>elections to Parliament<\/strong>, <strong>state legislatures<\/strong>, the office of<strong> president of India,<\/strong> and the office of <strong>vice-president of India.<\/strong><\/li>\n<li><strong>Powers and responsibilities ECI:<\/strong>\n<ul>\n<li><strong>Determining the Electoral Constituencies\u2019 territorial areas<\/strong> throughout the country.<\/li>\n<li><strong>Preparing and periodically revising electoral rolls<\/strong> and <strong>registering all eligible voters.<\/strong><\/li>\n<li><strong>Notifying the schedules and dates of elections<\/strong> and <strong>scrutinizing nomination papers.<\/strong><\/li>\n<li><strong>Granting recognition to the various political parties<\/strong> and <strong>allocating them election symbols.<\/strong><\/li>\n<li>The Commission also has <strong>advisory jurisdiction in the matter of post-election disqualification <\/strong>of sitting members of Parliament and State Legislatures.<\/li>\n<li>It <strong>issues the Model Code of Conduct in elections<\/strong> for political parties and candidates so that no one indulges in unfair practice or there is no arbitrary abuse of powers by those in power.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Composition:<\/strong> The commission consists of a <strong>Chief Election Commissioner (CEC) and two Election Commissioners (ECs).<\/strong><\/li>\n<li><strong>How are <\/strong>the CEC and ECs<strong> currently appointed?<\/strong>\n<ul>\n<li>Under <strong>Article 324 (2)<\/strong>, the <strong>President appoints<\/strong> the <strong>CEC <\/strong>and other <strong>ECs.<\/strong><\/li>\n<li>The President makes the appointment <strong>on the advice of the Union Council of Ministers <\/strong>headed by the Prime Minister.<\/li>\n<li>The <strong>Constitution does not prescribe any qualifications<\/strong>, academic or otherwise, for appointment to these offices.<\/li>\n<li>The <strong>tenure of office and the conditions of service<\/strong> of all the commissioners is <strong>determined by the President.\u00a0<\/strong><\/li>\n<li><strong>The tenure<\/strong> of commissioners <strong>is<\/strong> <strong>6 years or up to the age of 65<\/strong>, whichever is earlier.<\/li>\n<li>The CEC and the two other ECs<strong> have the same powers and emoluments,<\/strong> including salaries, which are the same <strong>as a Supreme Court judge<\/strong>.<\/li>\n<li><strong>All three commissioners have the same right of taking a decision<\/strong>. <strong>In case of a difference of opinion<\/strong> amongst the three members, the matter is <strong>decided by the Commission by a majority.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Can CEC and ECs be removed?<\/strong>\n<ul>\n<li><strong>Article 324<\/strong> of The Constitution of India <strong>mentions the provisions to safeguard and ensure the independent<\/strong> and impartial <strong>functioning of the Election Commission.<\/strong><\/li>\n<li><strong>The CEC is provided with security of tenure.<\/strong> He<strong> cannot be removed from his office except in the same manner<\/strong> and on the same grounds <strong>as a judge of the Supreme Court.\u00a0<\/strong><\/li>\n<li><strong>Any other election commissioner<\/strong> or a regional commissioner <strong>cannot be removed from office except on the recommendation of the CEC.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>What does the recent Supreme Court ruling say?<\/strong>\n<ul>\n<li>The <strong>CEC and other ECs should be appointed by the President on the advice of a committee<\/strong> comprising the prime minister, the leader of the opposition in the Lok Sabha, and the Chief Justice of India.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1)\u00a0What is the mandate of Election Commission of India (ECI)?<\/h3>\n<p>The Election Commission of India is an autonomous constitutional authority responsible for administering Union and State election processes in India.
