


{"id":36697,"date":"2023-08-05T01:40:01","date_gmt":"2023-08-04T20:10:01","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=36697"},"modified":"2025-10-11T10:51:56","modified_gmt":"2025-10-11T05:21:56","slug":"privilege-motion","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/privilege-motion\/","title":{"rendered":"Privilege Motion"},"content":{"rendered":"<h3><strong>What\u2019s in today\u2019s article?<\/strong><\/h3>\n<ul>\n<li><strong>Why in News?<\/strong><\/li>\n<li><strong>What is a Privilege Motion?<\/strong><\/li>\n<li><strong>What is the Committee of Privileges in Parliament?<\/strong><\/li>\n<li><strong>Cases where the Privilege Motion led to the Expulsion from the House<\/strong><\/li>\n<li><strong>What is the Basis of the Recent Complaints against the MPs?<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Why in News?<\/strong><\/h2>\n<ul>\n<li>Rajya Sabha Chairman referred complaints related to the privilege of the House against two MPs (TMC\u2019s Derek O\u2019Brien and AAP\u2019s Raghav Chadha) to the privileges committee.<\/li>\n<li>This comes amid differences between the ruling party and some opposition parties that have plagued the ongoing Monsoon Session of its sittings.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<h2><strong>What is a Privilege Motion?<\/strong><\/h2>\n<ul>\n<li><strong>The <\/strong><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/parliamentary-privileges\/\" target=\"_blank\"><strong><u>Parliamentary privilege<\/u><\/strong><\/a> are certain rights conferred to the Members of Parliament (MPs) for conducting the business of the Parliament.<\/li>\n<li><strong>There is no codified list of the exact privileges<\/strong>, but it includes the <strong>right of free expression<\/strong> in the course of Parliamentary debates and MPs <strong>will not be liable for court proceedings<\/strong> for this.<\/li>\n<li><strong>If such a privilege is breached<\/strong>, a motion can be raised by any member and can be admitted by the RS Chairman.<\/li>\n<li>They can then refer it to the <strong>Privileges Committee<\/strong> under Rule 203 of <strong>Rules of Procedure and Conduct of Business<\/strong> in the Council of States\/RS.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>What is the Committee of Privileges in Parliament?<\/strong><\/h2>\n<ul>\n<li><strong>This committee consists <\/strong>of 15 members in Lok Sabha (10 in case of RS) <strong>nominated <\/strong>by the Speaker (Chairman in case of RS) from time to time.<\/li>\n<li>In the RS,<strong> the deputy chairperson<\/strong> is appointed (by the RS Chairman) as the head of the committee of privileges.<\/li>\n<li><strong>The committee examines<\/strong> every question involving a breach of privilege of the House or of the members or of any Committee referred to it by the Speaker\/Chairman and <strong>makes suitable recommendations in its report<\/strong>.\n<ul>\n<li>If the House has not fixed any time for the presentation of the report, it shall be presented <strong>within 1 month<\/strong> of the date on which reference to the Committee was made.<\/li>\n<li>Once presented, a motion has to be passed for the consideration of the report and amendments can be suggested.<\/li>\n<\/ul>\n<\/li>\n<li>The right to raise a question of privilege is <strong>based on satisfying two conditions<\/strong> &#8211; the question shall be restricted to a specific matter of recent occurrence and the matter requires the intervention of the Council.<\/li>\n<li><strong>The Speaker\/RS Chairman is the first level of scrutiny of a privilege motion<\/strong>. Therefore, the Speaker\/Chairman can decide on the privilege motion himself or herself or refer it to the privileges committee of Parliament.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>Cases where the Passing of Motion led to the Expulsion from the House:<\/strong><\/h2>\n<ul>\n<li>A large number of notices are rejected, with penal action recommended in only a few cases.<\/li>\n<li><strong>In 1978<\/strong>, Indira Gandhi, who had just won the LS elections from Chikmagalur, was expelled from the House. It was the culmination of a year-long investigation by such a committee in the LS.<\/li>\n<li>Then home minister Charan Singh moved a resolution of breach of privilege against her following observations made by the<strong> Justice Shah Commission<\/strong>, which probed excesses during the Emergency. Another case was the expulsion of Subramanian Swamy from the RS in 1976.<\/li>\n<li>He was charged with bringing disrepute to Parliament through his activities through interviews in foreign publications that were construed as \u201canti-India propaganda\u201d.<\/li>\n<\/ul>\n<p><strong>\u00a0<\/strong><\/p>\n<h2><strong>What is the Basis of the Recent Complaints against the MPs?<\/strong><\/h2>\n<ul>\n<li>According to the RS secretariat, notice against O\u2019Brien was filed for <strong>publishing the clippings of his statement<\/strong> made in the House on his <strong>Twitter handle<\/strong>, despite those being removed from the record by the chairman.<\/li>\n<li>The complaint against Chadha alleges an intentional and deliberate act of<strong> presenting misleading facts to the media<\/strong> with respect to the suspension of an AAP\u2019s MP (Sanjay Singh) from the remaining period of the Monsoon session of RS.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3><strong>Q1) What are the different sessions of Parliament of India?<\/strong><\/h3>\n<p>By convention, Parliament meets for three sessions in a year. The longest is the Budget Session (January-April). The second session is the three-week Monsoon Session (July-August.
