


{"id":3767,"date":"2023-03-06T04:31:31","date_gmt":"2023-03-05T23:01:31","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=3767"},"modified":"2025-03-26T19:16:51","modified_gmt":"2025-03-26T13:46:51","slug":"army-court-martial","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/army-court-martial\/","title":{"rendered":"Army Court Martial"},"content":{"rendered":"<h2><strong>About Army Court Martial:<\/strong><\/h2>\n<ul>\n<li>A court-martial has been granted the authority <strong>to judge the guilt of members of the armed forces <\/strong>which is subject to military law, and, in the case, if the accused or defendant is found guilty, to decide upon punishment which they have to carry.<\/li>\n<\/ul>\n<h3><strong>What is the legal provision related to court martial in India?<\/strong><\/h3>\n<ul>\n<li>The <strong>Armed Forces Tribunal Act 2007<\/strong> was passed by the Parliament and led to the formation of the Armed Forces Tribunal.<\/li>\n<li>This tribunal is empowered with the adjudication of disputes and complaints concerning the commission, appointments, enrolments and conditions of service in respect of persons subject to <strong>the Army Act, 1950, The Navy Act, 1957 and the Air Force Act, 1950<\/strong><\/li>\n<li><strong>Composition of the Armed Forces Tribunal<\/strong>\n<ul>\n<li>The Judicial Members are <strong>retired High Court Judges<\/strong> and Administrative Members are <strong>retired Members of the Armed Forces<\/strong> who have held the rank of Major General\/ equivalent or above for a period of three years or more.<\/li>\n<li>Judge Advocate General (JAG) who has held the appointment for at least one year is also entitled to be appointed as the Administrative Member.<\/li>\n<\/ul>\n<\/li>\n<li>There are <strong>four kinds<\/strong> of courts-martial in India namely; General Court Martial (GCM), District Court Martial (DCM), Summary General Court Martial (SGCM) and Summary Court Martial (SCM).<\/li>\n<li>Under the Army Act, army courts can try personnel for all kinds of offences, <strong>except for murder and rape of a civilian<\/strong>, which are primarily tried by a <strong>civilian court of law.<\/strong>\u00a0<\/li>\n<li><strong>Pardoning power:<\/strong> The <strong>president of India<\/strong> can use his judicial power <strong>under Article 72<\/strong> of the Constitution to pardon, reprieve, respite or remission of punishment or sentence given by a court martial.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1)Who can remove the High court judges in India?<\/h3>\n<p>The constitution provides that a judge can be removed only by an order of the president, based on a motion passed by both houses of parliament.
