Functions of CCPA: It is empowered to:\n<ul>\n<li>conduct investigations into violation of consumer rights and institute complaints \/ prosecution,<\/li>\n<li>order recall of unsafe goods and services,<\/li>\n<li>order discontinuation of unfair trade practices and misleading advertisements,<\/li>\n<li>impose penalties on manufacturers\/endorsers\/publishers of misleading advertisements.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>News Summary: CCPA probing IAS coaching centres for misleading ads<\/h2>\n<ul>\n<li>India&#8217;s consumer protection regulator, CCPA, is investigating 20 IAS coaching centres for alleged misleading advertisements and unfair trade practices.<\/li>\n<li>The centres are accused of using toppers and successful candidates&#8217; names and pictures to influence prospective aspirants.<\/li>\n<li>Four centres have already been fined Rs 1 lakh each.<\/li>\n<\/ul>\n<h2>Observations made by CCPA<\/h2>\n<ul>\n<li>Every time the results of any competitive exam, including the UPSC Civil Services, are announced, coaching institutes would go an advertising spree.<\/li>\n<li>Names and pictures of the top rankers are used in these ads to indicate their enrolment at the institute.<\/li>\n<li>However, they do not disclose the nature of the enrolment, that is, the course they might have pursued in the institute.\n<ul>\n<li>Ideally, the advertisements must include the course they enrolled for (which could be a test series, learning course or a revision course).<\/li>\n<\/ul>\n<\/li>\n<li>Thus, it would qualify as deliberate concealment of important information and categorisation as a <u>\u2018misleading advertisement\u2019 under Section 2(28) of the Consumer Protection Act, 2019<\/u>.\n<ul>\n<li>First time violations may invite penalties up to Rs 10 lakh.<\/li>\n<li>Subsequent violations may attract penalties up to Rs 50 lakh, with other potential legal action should the non-compliance continue.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>Coaching industries in India<\/h2>\n<ul>\n<li>Size of coaching industries\n<ul>\n<li>According to a study, the coaching class market in <u>India is expected to reach about Rs 1.79 lakh crore by 2030<\/u>.<\/li>\n<li>It is expected to grow at a Compounded Annual Growth Rate of 14.07% over a forecast period of 2023-30.<\/li>\n<li>Categorising the market based on types and channels, the study highlights that higher education holds the largest market share \u2014 of about 32.75% in 2022.\n<ul>\n<li>This is expected to increase to 34.75% over the same forecast period.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li>Key factors that have led to the creation of a thriving market\n<ul>\n<li>Poor quality of teaching in schools<\/li>\n<li>High competition<\/li>\n<li>Increased preference for high-quality education among parents<\/li>\n<li>New generation wants to achieve things quickly and easily<\/li>\n<li>Increased income level<\/li>\n<li>Increase in the number of students pursuing higher education and professional courses<\/li>\n<li>To gain a competitive edge and improve their academic performance\n<ul>\n<li>Coaching institutes provide students with tools like practice exams, study guides, and individual tutoring.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1)\u00a0What are misleading advertisements?<\/h3>\n<p>A misleading advertisement is one that deceives or is likely to deceive people.
