Restraint in Campaigning?<\/li>\n<\/ul>\n<h2>Why in News?<\/h2>\n<p>Sunita Kejriwal, wife of Delhi Chief Minister Arvind Kejriwal, was appointed as a \u2018star campaigner\u2019 by the Aam Aadmi Party (AAP) for its campaign in Gujarat.<\/p>\n<h2>What are the Legal Provisions for Star Campaigners?<\/h2>\n<ul>\n<li><strong>Section 77 of the Representation of the People Act 1951 (RP Act)<\/strong> provides for law relating to expenditure incurred by \u2018leaders of a political party\u2019.\n<ul>\n<li>These \u2018leaders of a political party\u2019 are popularly known as \u2018<strong>star campaigners<\/strong>\u2019.<\/li>\n<\/ul>\n<\/li>\n<li>These star campaigners are usually the top leaders of a political party but <strong>can include other celebrities as well<\/strong>.<\/li>\n<li><strong>The only requirement<\/strong> is that these persons have to be members of the political party that appoints them.<\/li>\n<li>The RP Act provides that <strong>a recognised political party<\/strong> (national or State) can appoint <strong>a maximum of 40-star campaigners<\/strong> while a registered <strong>unrecognised <\/strong>political party can appoint up to <strong>20<\/strong>.<\/li>\n<li><strong>These names are to be communicated <\/strong>to the Election Commission (EC) and Chief Electoral Officer (CEO) of the States as applicable <strong>within seven days<\/strong> from the date of notification of such election.<\/li>\n<li><strong>In case of a multi-phase election<\/strong>, a political party can submit a separate list of star campaigners for different phases.<\/li>\n<\/ul>\n<h2>What Benefits Do Star Campaigners Get?<\/h2>\n<ul>\n<li>The RP Act provides that <strong>expenditure incurred <\/strong>by the \u2018leaders of a political party\u2019 on account of <strong>travel <\/strong>for campaigning for their political party shall not be deemed to be part of the election expenditure of a candidate of such party.\n<ul>\n<li>The election expenditure limit for candidates is <strong>\u20b995 lakh<\/strong> per Lok Sabha constituency in larger States and<strong> \u20b975 lakh<\/strong> in smaller States.<\/li>\n<li>Hence, these star campaigners would be <strong>vote-fetchers for candidates<\/strong> set up by respective parties <strong>without affecting their expenditure limit<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<li><strong>However, this is applicable only <\/strong>if the star campaigners limit themselves to <strong>general campaigning<\/strong> for the party.\n<ul>\n<li>If in any rally\/meeting organised, the star campaigner seeks votes in the name of contesting candidate(s) or shares the dais with them, then the rally\/meeting expense shall be apportioned to the election expenditure of such candidate(s).<\/li>\n<\/ul>\n<\/li>\n<li>If the star campaigner incurs <strong>boarding\/lodging expenses<\/strong> while campaigning for any candidate(s), it shall be included in the expenditure account of such candidate(s) irrespective of whether it is paid for by the candidate(s).<\/li>\n<li>Further, if any candidate(s) travel with the star campaigner, then <strong>50% of the travel expenditure of the star campaigner<\/strong> shall also be apportioned to such candidate(s).<\/li>\n<\/ul>\n<h2>What are the Concerns Regarding Campaigning by the Star Campaigners?<\/h2>\n<ul>\n<li>The star campaigners of all parties have been found <strong>guilty of using inappropriate and abusive words <\/strong>against leaders of other political parties.\n<ul>\n<li><strong>They were appealing to caste\/communal feelings<\/strong> of electors and making unsubstantiated allegations.<\/li>\n<\/ul>\n<\/li>\n<li>Another issue is with respect to the <strong>assessment of expenditure incurred<\/strong> for the rally\/meeting of such star campaigners which is always significantly lower than the actual expenditure.\n<ul>\n<li>This may be due to the rate card used by the EC that does not reflect current market rates for various items.<\/li>\n<li><strong>This results in lower apportionment of expenditure to contesting candidates.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h2>What Needs to be Done to Maintain Decorum and Restraint in Campaigning?<\/h2>\n<ul>\n<li>At present, the RP Act stipulates that <strong>political parties can appoint or revoke<\/strong> the appointment of star campaigners.\n<ul>\n<li>As per<strong> Article 324 of the Constitution<\/strong>, the EC is the highest authority that has been vested with the powers of superintendence and control of elections.<\/li>\n<li>Hence, <strong>the law may be amended to authorise the EC to revoke the \u2018star campaigner\u2019 status of a leader<\/strong>, in case of any serious violation of Model Code of Conduct.<\/li>\n<li>This would <strong>hopefully instil a sense of responsibility <\/strong>among them and ensure that campaigns maintain the necessary decorum and restraint.<\/li>\n<\/ul>\n<\/li>\n<li>Also, the <strong>assessment <\/strong>and apportionment of rally\/meeting expenses where star campaigners\u2019 campaign for particular candidate(s) <strong>should be made more robust.<\/strong><\/li>\n<\/ul>\n<hr \/>\n<h3>Q.1. What are recognised political parties in India?<\/h3>\n<p>A registered party is recognised as a National\/state Party (by the Election Commission of India) only if it fulfils certain conditions.
