{"id":4357,"date":"2023-01-21T05:27:09","date_gmt":"2023-01-20T23:57:09","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=4357"},"modified":"2025-03-26T23:53:20","modified_gmt":"2025-03-26T18:23:20","slug":"what-is-nikah-halala","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-nikah-halala\/","title":{"rendered":"What is Nikah Halala?"},"content":{"rendered":"<p><strong>About Nikah Halala:<\/strong><\/p>\n<ul>\n<li>The term \u201cNikah\u201d and \u201cHalala\u201d both are Arabic terms.<\/li>\n<li>\u201c<strong>Nikah\u201d means Marriage and \u201cHalala\u201d means to make something halal or permissible.<\/strong><\/li>\n<li>The expression \u201cNikah Halala\u201d <strong>literally means a marriage to make something halal or permissible.<\/strong><\/li>\n<li>As per Muslim Law, A man cannot remarry his wife after he divorced her, unless the wife is married to another man and gets divorced from that man (second husband) or after the death of the second husband.\u00a0<\/li>\n<li>Thus <strong>t<\/strong><strong>he process of making the woman permissible for her first husband by giving her marriage to a third person with a pre-condition is known as Nikah Halala also known as<\/strong> T<strong>ahleel marriage.<\/strong><\/li>\n<li>In this process, the third person consummates the marriage with the object to make the woman permissible for her first husband.<\/li>\n<li><strong>Does the Quran permit this<\/strong><strong>?<\/strong> There is <strong>no sanction in the holy Quran for such marriages.<\/strong><\/li>\n<li><strong>Legality of Nikah halala in India:\u00a0<\/strong><\/li>\n<li>The <strong>Muslim Women (Protection of Rights on Marriage) Act, 2019 passed after the invalidation of triple talaq by the Supreme Court, is silent on nikah halala<\/strong>.\u00a0<\/li>\n<li>The Act made instant triple talaq a criminal offence but steered clear of halala which takes place as a consequence of triple talaq.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<p><strong>Q1:<\/strong> What is Triple Talaq?<\/p>\n<p>It is a form of divorce that was practiced in Islam, whereby a Muslim man could divorce his wife by pronouncing talaq three times.
