


{"id":4653,"date":"2024-06-21T04:10:15","date_gmt":"2024-06-20T22:40:15","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=4653"},"modified":"2025-03-27T01:38:25","modified_gmt":"2025-03-26T20:08:25","slug":"what-is-an-advance-medical-directiveliving-will","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-an-advance-medical-directiveliving-will\/","title":{"rendered":"What is a Living Will?"},"content":{"rendered":"<h2>About Living Will<\/h2>\n<ul>\n<li>A Living Will or <strong>Advance Medical Directive<\/strong>, is a document prescribing a <strong>person&#8217;s wishes regarding the medical treatment <\/strong>the person would want <strong>if he\/she was unable to share<\/strong> his\/her wishes or not in a position to make an informed decision by reason of being unconscious or in a coma.\u00a0<\/li>\n<li><strong>Legality<\/strong> of Living Will in India:\u00a0\n<ul>\n<li>It was <strong>not legally viable<\/strong> in India <strong>until 2018.<\/strong><\/li>\n<li>However, the Supreme Court <strong>in Common Cause vs. Union of India (2018), recognised<\/strong> that a terminally ill patient or a person in a persistent vegetative state can execute an \u201cadvance medical directive\u201d or a \u201cliving will &#8221; to refuse medical treatment, and gave sanction to passive euthanasia and <strong>living will\/advance directives.<\/strong><\/li>\n<li>The court also <strong>laid down principles<\/strong> relating to the procedure <strong>for execution of a living will.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3>Who can draw up an Advance Medical Directive\/Living Will?<\/h3>\n<ul>\n<li>An <strong>adult who is of a sound<\/strong> and <strong>healthy mind<\/strong> and in a position to communicate, relate, and comprehend the purpose and consequences of executing the document.<\/li>\n<li>It <strong>must be voluntary.<\/strong><\/li>\n<\/ul>\n<h3>Elements of a Living Will<\/h3>\n<ul>\n<li>It <strong>should be in writing<\/strong> and <strong>clearly state when medical treatment may be withdraw nor if specific medical treatment<\/strong> that will have the effect of delaying the process of death <strong>should be given.<\/strong><\/li>\n<li>Instructions must be absolutely <strong>clear and unambiguous.<\/strong><\/li>\n<li>It should <strong>mention whether<\/strong> the <strong>patient may revoke the instructions<\/strong>\/authority at any time.<\/li>\n<li>It should <strong>specify the name of a guardian or close relative<\/strong> who, <strong>in the event of<\/strong> the <strong>patient becoming incapable of taking decision<\/strong> at the relevant time, will be <strong>authorized to give consent to refuse or withdraw medical treatment.<\/strong><\/li>\n<\/ul>\n<h3>How is Living Will recorded?<\/h3>\n<ul>\n<li>It should be <strong>signed by the patient<\/strong> in the presence of <strong>two witnesses<\/strong>, preferably independent, and <strong>countersigned by a jurisdictional Judicial Magistrate First Class<\/strong> (JMFC), so designated by the concerned district judge.<\/li>\n<li>The <strong>JMFC<\/strong> is under an <strong>obligation to supply <\/strong>the requisite <strong>copies of the Living Will to the concerned authorities<\/strong> and to <strong>inform the immediate family members<\/strong> of the Executor.\u00a0<\/li>\n<li><strong>When and by whom can it be given effect to?<\/strong>\n<ul>\n<li><strong>When the person becomes terminally ill<\/strong> and is undergoing prolonged medical treatment with <strong>no hope of recovery<\/strong> and cure of the ailment, th<strong>e treating physician<\/strong>, when made aware about the Advance Directive, <strong>has to ascertain<\/strong> the genuineness and <strong>authenticity of the document from the jurisdictional JMFC before acting upon the same.<\/strong><\/li>\n<li>The <strong>physician <\/strong>of the Executor <strong>shall then inform the Executoror<\/strong> his <strong>guardian<\/strong>\/close relative, inter alia, about the <strong>details of the illness<\/strong> and the consequences of remaining untreated.\u00a0<\/li>\n<li>The <strong>hospital<\/strong> where the Executor has been admitted shall <strong>constitute a Medical Board<\/strong> to form an opinion on whether to certify the instructions regarding withdrawal or refusal of further medical treatment.<\/li>\n<li><strong>In the event <\/strong>the <strong>Hospital Medical Board certifies the instructions<\/strong>, the hospital shall forthwith <strong>inform the jurisdictional Collector<\/strong> about the proposal, <strong>who shall then constitute its own Medical Board.<\/strong><\/li>\n<li><strong>This Board<\/strong> jointly visits the hospital, and <strong>if they concur with the decision<\/strong> of the previous Medical Board, they may <strong>endorse the certificate to carry out<\/strong> the instructions given in the <strong>Living Will.<\/strong><\/li>\n<li>The<strong> Chairman of the Medical Board<\/strong> shall <strong>convey the decision of the Board to<\/strong> the <strong>jurisdictional JMFC.<\/strong><\/li>\n<li>Thereafter, the <strong>JMFC shall visit the patient<\/strong> and, after examining all aspects, <strong>authorise the implementation<\/strong> of the decision of the Board.\u00a0<\/li>\n<li><strong>In case the life support is withdrawn<\/strong>, the same <strong>shall be intimatedby the Magistrate to the High Court,<\/strong> and the High Court shall maintain the requisite records in digital format.<\/li>\n<li>However, <strong>if there is a difference of opinion between<\/strong> the <strong>Board and the Executor or his family members<\/strong>, the parties can prefer a <strong>writ petition in<\/strong> the concerned <strong>High Court<\/strong>. The <strong>decision of the High Court<\/strong> in this regard shall be <strong>final and binding.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<hr \/>\n<h3>Q1: What is active and passive euthanasia?<\/h3>\n<p>Active euthanasia occurs when the medical professionals, or another person, deliberately do something that causes the patient to die.
