Any deviation from mutual consent challenges the treaty\u2019s fundamental design.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India has consistently favoured the Neutral Expert route, while Pakistan has pushed for the arbitration court on issues like the design of hydropower projects.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India maintains that parallel proceedings before both mechanisms violate the treaty&#8217;s structure and purpose.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>India\u2019s Rejection of the Court of Arbitration\u2019s Authority<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recently, the Hague-based Court of Arbitration issued a supplemental award asserting its jurisdiction over disputes concerning the Kishenganga and Ratle hydropower projects in Jammu and Kashmir.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India has categorically rejected the authority of the Court of Arbitration, labelling it \u201c<\/span><b><i>illegally constituted<\/i><\/b><span style=\"font-weight: 400;\">\u201d and devoid of legal legitimacy.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ministry of External Affairs (MEA) stated that the <\/span><b>very constitution of the court violates the provisions of the IWT, and hence, any decisions or awards issued by it are \u201cper se void.\u201d<\/b><span style=\"font-weight: 400;\">\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">India reiterated that it never recognised the court\u2019s authority and views its functioning as lacking legal standing.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In response to Pakistan&#8217;s request, the arbitration court examined India\u2019s move to place the IWT in abeyance after the April 22 Pahalgam terror attack, which killed 26 Indian civilians.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India clarified that its suspension of treaty obligations was a sovereign act justified under international law and that <\/span><b>a tribunal formed without mutual consent has no jurisdiction over such decisions<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Pakistan\u2019s Legal Strategy and India\u2019s Firm Opposition<\/strong><\/h2>\n<ul style=\"text-align: justify;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India has accused Pakistan of manipulating international legal mechanisms to divert global attention from its support of cross-border terrorism.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The MEA described the court\u2019s proceedings as a \u201c<\/span><b><i>charade at Pakistan\u2019s behest<\/i><\/b><span style=\"font-weight: 400;\">\u201d and reiterated that Pakistan must permanently renounce terrorism before India considers resuming its treaty obligations.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The legal confrontation stems from longstanding differences over the design parameters of the Kishenganga (Jhelum tributary) and Ratle (Chenab) hydroelectric projects.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In 2015, Pakistan approached the World Bank for the appointment of a Neutral Expert, but later shifted to seek arbitration in 2016.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">India, upholding the original treaty provisions, continued to insist on the Neutral Expert route, rejecting arbitration as a breach of the IWT&#8217;s sequential dispute resolution framework.<\/span><\/li>\n<\/ul>\n<h2 style=\"text-align: justify;\"><strong>Treaty Review, Neutral Expert Engagement, and Strategic Implications<\/strong><\/h2>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Consequently, while India has actively participated in the Neutral Expert proceedings, it has refused to recognise or engage with the arbitration court.<\/span><\/li>\n<li style=\"font-weight: 400;
