


{"id":5244,"date":"2024-10-01T08:34:27","date_gmt":"2024-10-01T03:04:27","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=5244"},"modified":"2025-10-03T11:12:37","modified_gmt":"2025-10-03T05:42:37","slug":"what-is-a-review-petition","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-a-review-petition\/","title":{"rendered":"What is a Review Petition?"},"content":{"rendered":"<h2><strong>About Review Petition:<\/strong><\/h2>\n<ul>\n<li>When a judgment is passed by a court, the doctrine of functus officio applies to it.<\/li>\n<li>This Latin doctrine means that if the judgment in a case has been pronounced or an order has been made following due process of law, in such circumstances, the case cannot be reopened.<\/li>\n<li>The right to file a review petition is an exception to this doctrine.<\/li>\n<li>The word \u201creview\u201d means to examine again.\u00a0<\/li>\n<li><strong>Article 137<\/strong> of the Constitution gives the <strong>Supreme Court<\/strong> the <strong>power to review any of its judgments or orders.<\/strong><\/li>\n<li>The court has the power to review its rulings <strong>to correct a \u201cpatent error\u201d and not \u201cminor mistakes of inconsequential import\u201d.<\/strong><\/li>\n<li><strong>Similarly, High Courts<\/strong> have also been <strong>given the power<\/strong> to review its judgments under <strong>Article 226 <\/strong>of the Constitution. However, it can <strong>only be invoked when <\/strong>there is a <strong>breach of law or violation of the Constitution.\u00a0<\/strong><\/li>\n<li><strong>Grounds for review petition<\/strong>: In a 2013 ruling, the Supreme Court itself laid down three grounds for seeking a review of a verdict it has delivered.\n<ul>\n<li>the <strong>discovery of new <\/strong>and important <strong>matter or evidence<\/strong> which was not within the knowledge of the petitioner or could not be produced by him;<\/li>\n<li><strong>mistake or error apparent on the face of the record<\/strong>; or<\/li>\n<li><strong>any other sufficient reason,<\/strong> which means a reason that is <strong>analogous to<\/strong> the <strong>other two grounds.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Procedure:<\/strong>\n<ul>\n<li><strong>Who can file<\/strong> a review petition? It is <strong>not necessary that only parties to a case<\/strong> can seek a reviewof the judgment on it. <strong>Any person aggrieved bya ruling<\/strong> can seek a review.<\/li>\n<li><strong>Time frame<\/strong>: As per 1996 rules framed by the Supreme Court, a review petition must be filed <strong>within 30 days of the date of judgment or order.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>While a judgment is the final decision in a case, an order is an interim ruling that is subject to its final verdict.\u00a0\n<ul>\n<li>The petition should <strong>clearly outline<\/strong> the <strong>grounds for review<\/strong> and <strong>include legal arguments and supporting precedents.<\/strong><\/li>\n<li>In general, review petitions in court are <strong>typically considered without oral arguments<\/strong> from lawyers. Instead, they are <strong>reviewed &#8220;through circulation&#8221; by<\/strong> the <strong>judges in their chambers<\/strong>. There are <strong>exceptional cases where an oral hearing<\/strong> may be <strong>permitted<\/strong>.\u00a0<\/li>\n<li>The review petition should be <strong>circulated to the same bench<\/strong> that delivered the judgment.<\/li>\n<li>However, if a Judge or bench is not available who delivered the original order\/ judgment due to various reasons, any other competent Court is authorized and empowered to deal with the review application.<\/li>\n<li>The <strong>Supreme Court will assess<\/strong> the petition to determine if it qualifies for review. <strong>In cases where<\/strong> the <strong>arguments lack substantial merit, the petition<\/strong> may be <strong>rejected<\/strong>.<\/li>\n<li><strong>If the review petition has been dismissed<\/strong> by the Court, then the <strong>aggrieved<\/strong> person is <strong>provided with a relief of Curative Petition<\/strong>.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<h3><strong>Q1<\/strong>: What is a curative petition?<\/h3>\n<p><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/what-is-a-curative-petition\/\" target=\"_blank\">Curative petition<\/a> is the last resort to the highest court that can be petitioned for redressal of grievances in court, and its ruling is final. It is a way to ask the court to review and revise their own decision, and it is filed after a review petition is dismissed or used. It can be entertained if the petitioner establishes there was a violation of the principles of natural justice and that he was not heard by the court before passing an order.
