


{"id":5628,"date":"2022-12-25T05:32:33","date_gmt":"2022-12-25T00:02:33","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=5628"},"modified":"2025-03-27T09:58:44","modified_gmt":"2025-03-27T04:28:44","slug":"what-is-abetment-of-suicide","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/what-is-abetment-of-suicide\/","title":{"rendered":"What is \u2018Abetment of Suicide\u2019?"},"content":{"rendered":"<h2><strong>What is abetment of suicide?<\/strong><\/h2>\n<p><strong>The Indian Penal Code, 1860 makes abetment of suicide a punishable offence.<\/strong><\/p>\n<ul>\n<li><strong>Section 306 of the Indian Penal Code (IPC) <\/strong>prescribes either a jail term of up to 10 years or a fine or both.<\/li>\n<li>\u201cIf any person commits suicide, whoever abets the commission of such suicide shall be punished with imprisonment of either imprisonment for a term which may extend to ten years, and shall also be liable to fine,\u201d Section 306 reads. Generally, the fine is paid to the kin of the deceased.<\/li>\n<li>The IPC also has a separate chapter on abetment and describes who is an abettor under <strong>Section 108.<\/strong><\/li>\n<li><strong>Abetment is defined as including instigating, engaging in a conspiracy or assisting in committing the offence.<\/strong><\/li>\n<\/ul>\n<h3><strong>How serious is the offence of abetment?<\/strong><\/h3>\n<ul>\n<li><strong>Abetment of suicide<\/strong> is a serious offence that is tried in a Sessions court and is cognizable, non-bailable and non-compoundable.<\/li>\n<li>A <strong>cognizable offence<\/strong> is one in which a police officer can make an arrest without a warrant from a court.<\/li>\n<li><strong>A non-bailable offence<\/strong> means bail is granted to the accused at the discretion of the court and not as a matter of right.<\/li>\n<li><strong>A non-compoundable offence<\/strong> is one in which the case cannot be withdrawn by the complainant even when the complainant and the accused have reached a compromise.<\/li>\n<\/ul>\n<h3><strong>Is abetment of suicide the same as murder?<\/strong><\/h3>\n<ul>\n<li>No, it is not<strong> same as murder<\/strong>. The Supreme Court clarified this issue in <strong>1997 in the case of \u2018Sangarabonia Sreenu v State of Andhra Pradesh\u2019.<\/strong><\/li>\n<li>Despite the intention of the accused to drive a person to commit suicide, abetment of suicide is not the same as murder.<\/li>\n<li>In the case of a murder, the final \u2018act\u2019 of causing the death of a person is committed by the accused, which is not the case in abetment of suicide.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1) What is the difference between the bailable and non-bailable offence?<\/h3>\n<p>In the case of a <a href=\"https:\/\/lawrato.com\/indian-kanoon\/criminal-law\/how-to-get-bail-in-india-bail-procedure-1792\" target=\"_blank\" rel=\"nofollow noopener\">bailable offence<\/a>, the grant of bail is a matter of right. It may be either given by a police officer who is having custody of the Accused or by the court. However, A non-bailable offence is one in which the grant of Bail is not a matter of right.
