


{"id":5724,"date":"2022-12-24T10:43:37","date_gmt":"2022-12-24T05:13:37","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=5724"},"modified":"2025-03-27T10:32:48","modified_gmt":"2025-03-27T05:02:48","slug":"cci-order-challenged-by-google-over-anticompetitive-practices","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/cci-order-challenged-by-google-over-anticompetitive-practices\/","title":{"rendered":"CCI order challenged by Google over anticompetitive practices"},"content":{"rendered":"<h2><strong>Why in the News?<\/strong><\/h2>\n<p>Google, was slapped with a fine of Rs 1,338 crore by CCI after being found guilty of anti-competitive behaviour in the Android mobile application ecosystem<\/p>\n<h3><strong>What are Anticompetitive practices?<\/strong><\/h3>\n<ul>\n<li>It refers to a wide range of business practices in which a firm or group of firms may engage to restrict inter-firm competition to maintain or increase their relative market position and profits without necessarily providing goods and services at a lower cost or of higher quality.<\/li>\n<\/ul>\n<h3><strong>What is CCI?<\/strong><\/h3>\n<ul>\n<li>The Competition Commission of India (CCI) was established in March 2009 by the Government of India under <strong>the Competition Act, 2002<\/strong> for the administration, implementation, and enforcement of the Act.<\/li>\n<li><strong>Composition of the CCI<\/strong>\n<ul>\n<li>The Commission consists of <strong>one Chairperson and six Members<\/strong>who shall be appointed by the Central Government.<\/li>\n<li>It is a <strong>quasi-judicial body<\/strong> which gives opinions to statutory authorities and also deals with other cases.<\/li>\n<li>The Chairperson and other Members shall be whole-time Members<\/li>\n<\/ul>\n<\/li>\n<li><strong>Objectives:<\/strong><\/li>\n<li>It will eliminate practices having adverse effects on competition.<\/li>\n<li>To Promote and sustain competition.<\/li>\n<li>It helps in protecting the interests of consumers.<\/li>\n<li>Ensuring freedom of trade in the markets of India.<\/li>\n<li>It will Establish a robust competitive environment through:<\/li>\n<\/ul>\n<h3><strong>What is NCLAT?<\/strong><\/h3>\n<ul>\n<li>It was constituted under Section 410 of <strong>the Companies Act, 2013<\/strong> for hearing appeals against the orders of the National Company Law Tribunal(s) (NCLT), with effect from 1st June 2016.<\/li>\n<li><strong>Functions:<\/strong>\n<ul>\n<li>Hearing appeals against the orders passed by NCLT(s) under Section 61 of <strong>the Insolvency and Bankruptcy Code, 2016<\/strong> (IBC).<\/li>\n<li>To hear and dispose of appeals against any direction issued or decision made or order passed by <strong>the Competition Commission of India (CCI).<\/strong><\/li>\n<\/ul>\n<\/li>\n<li>It also hears and disposes of appeals against the orders of the <strong>National Financial Reporting Authority.<\/strong><\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1)\u00a0What are the effects of anti-competitive practices?<\/h3>\n<p>The most obvious effect of such practices is seen in the form of price increases in markets involving output-restricting or price- fixing cartels and dominant firms abusing their market power.
