{"id":58566,"date":"2025-08-07T12:50:37","date_gmt":"2025-08-07T07:20:37","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=58566"},"modified":"2025-08-07T13:25:16","modified_gmt":"2025-08-07T07:55:16","slug":"legal-insanity","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/legal-insanity\/","title":{"rendered":"Legal Insanity"},"content":{"rendered":"<h2><b>Legal Insanity Latest News<\/b><\/h2>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400;\">The Chhattisgarh High Court recently acquitted a man of double murder due to legal insanity, highlighting the importance of mental state in trials.<\/span><\/p>\n<h2><b>About Legal Insanity<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is a term used to describe a <\/span><b>mental state<\/b><span style=\"font-weight: 400;\"> that is <\/span><b>severe enough to prevent a person <\/b><span style=\"font-weight: 400;\">from <\/span><b>having legal capacity <\/b><span style=\"font-weight: 400;\">and<\/span><b> excuses them from criminal responsibility.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is a<\/span><b> recognised defence in criminal law.<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is based on the<\/span> <span style=\"font-weight: 400;\">assumption that <\/span><b>at the time of the crime, <\/b><span style=\"font-weight: 400;\">the <\/span><b>defendant <\/b><span style=\"font-weight: 400;\">was <\/span><b>suffering from severe mental illness<\/b><span style=\"font-weight: 400;\"> and therefore, was <\/span><b>incapable of appreciating the nature of the crime <\/b><span style=\"font-weight: 400;\">and <\/span><b>differentiating right from wrong<\/b><span style=\"font-weight: 400;\"> behavior, hence<\/span><b> making them not legally accountable for the crime<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The insanity defense is a <\/span><b>legal concept, not a clinical one (medical one)<\/b><span style=\"font-weight: 400;\">. This means that <\/span><b>just suffering from a mental disorder is not sufficient <\/b><span style=\"font-weight: 400;\">to prove insanity.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To benefit from legal insanity, the<\/span><b> accused must establish,<\/b><span style=\"font-weight: 400;\"> often through psychiatric or psychological evaluations, that <\/span><b>they were not in control of their reasoning faculties <\/b><span style=\"font-weight: 400;\">during the commission of the prohibited act.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The accused must present a prima facie case, supported by reasonable materials, to establish their legal insanity.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This <\/span><b>may involve presenting evidence of their conduct before, during, or immediately after the offence,<\/b><span style=\"font-weight: 400;\"> along <\/span><b>with relevant medical documentation.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The objective is to convince the court that, due to mental incapacity, the accused should be exempt from full criminal responsibility.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">There are <\/span><b>different types <\/b><span style=\"font-weight: 400;\">of legal insanity, such as <\/span><b>emotional insanity,<\/b><span style=\"font-weight: 400;\"> which is when a person experiences a <\/span><b>violent excitement of emotions or passions that creates complete derangement of intellect.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Another type is<\/span><b> temporary insanity,<\/b><span style=\"font-weight: 400;\"> which <\/span><b>only exists at the time of a criminal act.<\/b><\/li>\n<\/ul>\n<h2><b>Legal Insanity in Recent Judgments<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>Supreme Court<\/b><span style=\"font-weight: 400;\"> in<\/span><b> Surendra Mishra vs. State of Jharkhand<\/b><span style=\"font-weight: 400;\"> (AIR 2011 SC 627) emphasised that <\/span><b>every person suffering from a mental disease <\/b><span style=\"font-weight: 400;\">is <\/span><b>not automatically exempted from criminal liability.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>accused bears the responsibility of proving legal insanity<\/b><span style=\"font-weight: 400;\"> and the onus can be discharged by demonstrating their conduct with reference to their medical condition.<\/span><\/li>\n<\/ul>\n<h2><b>What is Medical Insanity?<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It refers to a <\/span><b>state of mental illness or psychological disorder <\/b><span style=\"font-weight: 400;\">that may require medical treatment.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is a<\/span><b> medical diagnosis<\/b><span style=\"font-weight: 400;\"> based on the individual\u2019s mental health condition.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It primarily <\/span><b>addresses the individual\u2019s health and well-being,<\/b> <b>aiming to diagnose and treat<\/b><span style=\"font-weight: 400;\"> mental illnesses for the person\u2019s benefit.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It does n<\/span><b>ot necessarily impact a person\u2019s ability to make decisions <\/b><span style=\"font-weight: 400;\">in their daily life.
