{"id":5916,"date":"2022-12-15T08:01:23","date_gmt":"2022-12-15T02:31:23","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=5916"},"modified":"2025-03-27T11:40:34","modified_gmt":"2025-03-27T06:10:34","slug":"two-sacrilege-bills-passed-by-the-punjab-government","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/two-sacrilege-bills-passed-by-the-punjab-government\/","title":{"rendered":"Two sacrilege Bills passed by the Punjab government"},"content":{"rendered":"<h2><strong>About:<\/strong><\/h2>\n<ul>\n<li>The Punjab Assembly had unanimously passed The Indian Penal Code (Punjab Amendment) Bill, and The Code of Criminal Procedure (Punjab Amendment) Bill in 2018.<\/li>\n<li>It stipulates punishment upto life imprisonment for injury, damage or <strong>sacrilege to Guru Granth Sahib, Bhagwat Gita, Holy Quran and Holy Bible with the intention to hurt the religious feelings of the people.<\/strong><\/li>\n<li>The Indian Penal Code (Punjab Amendment) Bill, 2018, seeks to <strong>amend the IPC by inserting Section 295AA.<\/strong><\/li>\n<li>Under the existing <strong>Section 295 A<\/strong> [Deliberate and malicious acts, intended to outrage religious feelings of any class by insulting its religion or religious beliefs], a convict can be awarded a maximum of three years\u2019 imprisonment with or without fine.<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<h2><strong>What is the Governor\u2019s function in passing a Bill?<\/strong><\/h2>\n<ul>\n<li><strong>Under Article 200, the Governor may<\/strong>\n<ul>\n<li>grant assent<\/li>\n<li>withhold assent<\/li>\n<li>return for reconsideration by the Legislature or<\/li>\n<li>reserve for the consideration of the President any Bill passed by the State legislature and presented to him for assent.<\/li>\n<\/ul>\n<\/li>\n<li>There is no time frame fixed in the Constitution for any of these functions.<\/li>\n<li>The Constitution makes it mandatory that the Governor should reserve for the President\u2019s consideration if, in his opinion, a Bill that \u201cso derogates from the <strong>powers of the High Court<\/strong> as to endanger the position which that Court is by this Constitution designed to fill\u201d.<\/li>\n<li><strong>In addition, the governor can also reserve the bill if it is of the following nature:<\/strong>\n<ul>\n<li>Ultra-vires, that is, against the provisions of the Constitution.<\/li>\n<li>Opposed to the Directive Principles of State Policy.<\/li>\n<li>Against the larger interest of the country.<\/li>\n<li>Of grave national importance.<\/li>\n<li>Dealing with compulsory acquisition of property under the Article of the Constitution.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3><strong>Q1)\u00a0What is sacrilege in Sikhism?<\/strong><\/h3>\n<p>&#8216;Beadbi&#8217; or &#8216;sacrilege&#8217; means being disrespectful towards Guru Granth Sahib Ji. The concept of sacrilege in Sikhism emanates largely from the fact that Sikhs consider the Guru Granth Sahib to be a living Guru.
