It stands as a constitutional safeguard for the promotion of social equality and the eradication of caste-based discrimination, reinforcing the foundational principles of equality and justice in India\u2019s democratic framework.<\/span><\/p>\n<h2><b>Article 17 of the Indian Constitution<\/b><\/h2>\n<p>Article 17 of the Indian Constitution abolishes \u201cuntouchability\u201d in every form and prohibits its practice. It makes enforcing any restrictions or disabilities based on untouchability a punishable offence. As part of the <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/right-to-equality\/\" target=\"_blank\"><strong>Right to Equality<\/strong><\/a> (Articles 14\u201318), this article ensures social justice and protects the dignity of all citizens, making any discriminatory act illegal and unconstitutional.<\/p>\n<h2><b>Article 17 of Indian Constitution<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Article 17 of Indian Constitution, is included under Part III &#8211; <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/fundamental-rights\/\" target=\"_blank\"><strong>Fundamental Rights<\/strong><\/a>, abolishes the practice of untouchability and prohibits its observance in any form. It:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Prescribes punishments for individuals or groups enforcing untouchability.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Includes preventive provisions to discourage discriminatory practices.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Ensures protection of the rights of victims and promotes their access to justice.<\/span><\/li>\n<\/ul>\n<h3><b>The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989<\/b><\/h3>\n<p><span style=\"font-weight: 400;\">This law provides an additional layer of protection for members of Scheduled Castes (SCs) and Scheduled Tribes (STs), addressing both untouchability and other acts of discrimination or violence. Union of India (AIR 1977) and Devrajiah v. B. Instead, it refers to the historical system of caste-based social disabilities. Practices such as social boycotts or exclusion from religious services, unless tied to caste-based discrimination, do not fall within the ambit of Article 17.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\"><b>People\u2019s Union for Democratic Rights v. Union of India (AIR 1982): <\/b><span style=\"font-weight: 400;\">The Supreme Court ruled that when private individuals violate rights guaranteed under Article 17, it is the duty of the State to intervene promptly. The State\u2019s obligation exists regardless of whether the affected individuals are capable of asserting their rights independently.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\"><b>State of Karnataka v. Appa Balu Ingale (AIR 1993): <\/b><span style=\"font-weight: 400;\">The Court expressed strong concern over the continued prevalence of untouchability, describing it as a form of modern slavery and a manifestation of the caste system. In this case, the respondents were accused of preventing the complainant from drawing water from a borewell solely because of their caste status.<\/span><\/li>\n<\/ul>\n<ul>\n<li aria-level=\"1\"><b>Indian Young Lawyers Association v.
