style=\"font-weight: 400;\">The central government is working on ensuring <\/span><b>uniform application of the \u2018creamy layer\u2019 condition in OBC reservations<\/b><span style=\"font-weight: 400;\"> across different sectors, including central and state government jobs, public sector enterprises, and universities.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A proposal\u2014prepared after consultations with multiple ministries, NITI Aayog, and the National Commission for Backward Classes (NCBC)\u2014seeks to address anomalies that have emerged from earlier Department of Personnel and Training (DoPT) circulars.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The move aims to ensure <\/span><b>fairness and consistency<\/b><span style=\"font-weight: 400;\"> in determining eligibility for reservation benefits, so that all deserving OBC candidates are treated equally across institutions and services.<\/span><\/li>\n<\/ul>\n<h2><b>The Concept of \u2018Creamy Layer\u2019<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The idea of the <\/span><b>creamy layer<\/b><span style=\"font-weight: 400;\"> in OBC reservations originated from the Supreme Court\u2019s <\/span><b><i>Indra Sawhney vs Union of India<\/i><\/b><span style=\"font-weight: 400;\"> (1992) judgment.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Court upheld the Mandal Commission\u2019s recommendations for OBC reservations but ruled that the more affluent and advanced sections among OBCs \u2014 called the creamy layer \u2014 must be excluded from quota benefits.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Following this, the DoPT issued a circular in 1993 specifying who would fall under the creamy layer.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Children of <\/span><b>high constitutional functionaries, senior officers in government, PSUs, and armed forces (above certain ranks)<\/b><span style=\"font-weight: 400;\">, as well as those in the professional class, trade, industry, or large property ownership, were excluded.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The rules also specified that:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Children of parents directly recruited to <\/span><b>Group A\/Class I posts<\/b><span style=\"font-weight: 400;\">, or promoted to such posts before age 40, were ineligible.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Children of parents both recruited to <\/span><b>Group B<\/b><span style=\"font-weight: 400;\"> posts also came under the creamy layer.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">In the armed forces, only children of officials up to the rank of <\/span><b>Lieutenant Colonel<\/b><span style=\"font-weight: 400;\"> could avail reservation.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">For non-government employees, an <\/span><b>income\/wealth ceiling<\/b><span style=\"font-weight: 400;\"> was applied.\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Initially set at \u20b91 lakh per year, this has been revised periodically and has stood at <\/span><b>\u20b98 lakh per annum since 2017<\/b><span style=\"font-weight: 400;\">.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"3\"><span style=\"font-weight: 400;\">Importantly, income from <\/span><b>salaries and agriculture<\/b><span style=\"font-weight: 400;\"> is excluded from this limit.<\/span><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Thus, the creamy layer framework ensures that <\/span><b>reservation benefits go to the truly disadvantaged sections of OBCs<\/b><span style=\"font-weight: 400;\"> and not to those who are already socially and economically advanced.<\/span><\/li>\n<\/ul>\n<p><strong>Also Check: <a gaps in the 1993 criteria, particularly for jobs outside the government sector, and issued a detailed clarification in October 2004.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This aimed to <\/span><span style=\"font-weight: 400;\">standardise how the creamy layer status was determined for children of those working in non-government organisations<\/span><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The new rule specified that parental income from salary and other sources (excluding agriculture) would be calculated separately.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">If either income stream exceeded the then ceiling of \u20b92.5 lakh annually for three consecutive years, the children would be deemed part of the creamy layer and ineligible for OBC reservation benefits.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, during 2004\u201314, these clarifications were <\/span><b>not widely enforced<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<\/ul>\n<h3><b>Stricter Enforcement Post-2014<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In late 2014, DoPT began scrutinising caste certificates more rigorously to check their compliance with the 2004 clarification.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This led to significant consequences in recruitment processes.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Between the Civil Services Examinations of 2015\u20132023 (batches 2016\u201324), the DoPT rejected more than 100 caste certificates of candidates who otherwise qualified as OBCs under the 1993 norms but were categorised as creamy layer under the 2004 criteria.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Interestingly, many of these candidates were still accepted as OBCs in other competitive exams based on the same caste certificates, highlighting inconsistencies in enforcement across different recruitment processes.<\/span><\/li>\n<\/ul>\n<h2><b>Efforts to Find \u2018Equivalence\u2019 in OBC Creamy Layer<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The rejection of more than 100 OBC candidates\u2019 caste certificates by DoPT (based on the 2004 clarification) created disputes.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">To address this, the government began consultations across ministries and &#8211; Proposed to be treated as creamy layer, just like central PSU executives since 2017.<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">However, executives with income within \u20b98 lakh (the ceiling for private sector persons) will not be classified as creamy layer.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Government-Aided Institutions<\/b><span style=\"font-weight: 400;\"> &#8211; Employees will be placed under creamy layer or non-creamy categories depending on the equivalence of their posts, service conditions, and pay scales with central or state governments.<\/span><\/li>\n<\/ul>\n<h2><b>The Likely Beneficiaries of Proposed Changes<\/b><\/h2>\n<ul>\n<li><b>Benefits for Government Employees\u2019 Families<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">If the proposed reforms are implemented, the <\/span><b>children of lower-level government employees<\/b><span style=\"font-weight: 400;\"> with annual salaries above \u20b98 lakh will gain the most.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">This would correct anomalies where, for instance, <\/span><b>children of government teachers enjoy OBC quota benefits<\/b><span style=\"font-weight: 400;\">, while children of employees in <\/span><b>government-aided institutions of similar rank are excluded<\/b><span style=\"font-weight: 400;\"> solely based on income.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Addressing State-Level Anomalies<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">Similar state-owned oil company was declared creamy layer based on income, despite the post being equivalent to lower-level government jobs.<\/span><\/li>\n<\/ul>\n<\/li>\n<li><b>Limited Impact on Private Sector<\/b>\n<ul>\n<li><span style=\"font-weight: 400;\">For employees in the private sector, little change is expected.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">The proposal acknowledges that establishing \u2018equivalence\u2019 in posts and pay in private jobs is extremely difficult due to wide variations.\u00a0<\/span><\/li>\n<li><span style=\"font-weight: 400;\">Thus,
