


{"id":6263,"date":"2023-03-20T06:08:03","date_gmt":"2023-03-20T00:38:03","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=6263"},"modified":"2025-03-27T13:46:16","modified_gmt":"2025-03-27T08:16:16","slug":"black-money-undisclosed-foreign-income-and-assets-and-imposition-of-tax-act-2015","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/black-money-undisclosed-foreign-income-and-assets-and-imposition-of-tax-act-2015\/","title":{"rendered":"Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015"},"content":{"rendered":"<h2><strong>About Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015:<\/strong><\/h2>\n<ul>\n<li>Black Money (Undisclosed Foreign Income and Assets) and Imposition of Tax Act, 2015, or the <strong>Black Money Act <\/strong>(as popularly known), has <strong>come into force<\/strong> w.e.f. <strong>01.07.2015.<\/strong><\/li>\n<li><strong>Objective:<\/strong> To create a deterring effect on illegal foreign transactions and <strong>bring back undisclosed Indian money abroad.<\/strong><\/li>\n<li><strong>Features of the Act:<\/strong>\n<ul>\n<li><strong>Applicability:<\/strong>\n<ul>\n<li>The Act will apply to all <strong>person resident in India.<\/strong><\/li>\n<li>It will also <strong>apply to a person being Not an ordinary resident<\/strong> or Non-resident <strong>but who was an ordinary resident<\/strong> of India d<strong>uring the previous year when<\/strong> undisclosed <strong>income was earned<\/strong> or assets acquired <strong>outside India.<\/strong><\/li>\n<li>Provisions of the Act will <strong>apply to both undisclosed foreign income<\/strong> and <strong>assets<\/strong> (including financial interest in any entity).<\/li>\n<\/ul>\n<\/li>\n<li><strong>Tax<\/strong>:\n<ul>\n<li>Undisclosed foreign income or assets shall be taxed at a <strong>flat rate of 30 percent.<\/strong><\/li>\n<li><strong>No deductions, exemptions,<\/strong> carry forward, or set-off shall be available while computing tax liability under the BM Act, <strong>unlike the Income Tax Act.<\/strong><\/li>\n<\/ul>\n<\/li>\n<li><strong>Penalties:<\/strong>\n<ul>\n<li>The penalty for non-disclosure of income or an asset located outside India will be equal to <strong>three times the amount of tax payable thereon<\/strong>, i.e., <strong>90 percent of the undisclosed income<\/strong> or the value of the undisclosed asset. <strong>This is in addition to the tax payable at 30%.<\/strong><\/li>\n<li>There are <strong>other penalties also<\/strong> leviable on account of <strong>non-disclosure of required information<\/strong> etc., and <strong>there are prosecution provisions also<\/strong> within the Act.<\/li>\n<\/ul>\n<\/li>\n<li><strong>One-time compliance opportunity:<\/strong>\n<ul>\n<li>The Act also provides a one-time compliance opportunity <strong>for a limited period<\/strong> to persons who have any undisclosed foreign assets which have hitherto not been disclosed for the purposes of Income-tax.<\/li>\n<li><strong>Such persons may file a declaration<\/strong> before the specified tax authority within a specified period, <strong>followed by payment of tax at the rate of 30 percent<\/strong> <strong>and an equal amount by way of penalty.<\/strong><\/li>\n<li>Such persons <strong>will not be prosecuted under the stringent provisions of the Act.<\/strong><\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<h3>Q1: What is Black Money?<\/h3>\n<p>Black money includes all funds earned through illegal activity and otherwise legal income that is not recorded for tax purposes.
