text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It operates on the principle that <\/span><b>individuals have a duty to exercise reasonable care for their own safety<\/b><span style=\"font-weight: 400;\"> and well-being.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>When someone fails to meet this duty<\/b> <b>and their actions<\/b><span style=\"font-weight: 400;\"> or omissions <\/span><b>contribute to their own injury <\/b><span style=\"font-weight: 400;\">or damages, <\/span><b>they may be considered partially at fault<\/b><span style=\"font-weight: 400;\"> for the harm suffered.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Contributory negligence <\/span><b>occurs when the plaintiff,<\/b> <b>through their own lack of care<\/b><span style=\"font-weight: 400;\">, <\/span><b>contributes to the damage resulting from the defendant&#8217;s negligence<\/b><span style=\"font-weight: 400;\"> or wrongful conduct.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The concept of Contributory negligence is <\/span><b>based on the principles of \u201cVolenti non-fit injuria\u201d.\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The maxim means that the <\/span><b>injury has suffered voluntarily<\/b><span style=\"font-weight: 400;\"> and the <\/span><b>defendant is not fully liable.\u00a0\u00a0<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It<\/span><b> serves as a defence<\/b><span style=\"font-weight: 400;\"> wherein the<\/span><b> defendant must demonstrate <\/b><span style=\"font-weight: 400;\">that the <\/span><b>plaintiff&#8217;s failure to exercise reasonable care for their safety played a role in the harm<\/b><span style=\"font-weight: 400;\"> suffered.<\/span>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For instance, if A, while travelling on the wrong side of the road, is struck by a vehicle driven recklessly by B coming from the opposite direction, A may be met with the defence of contributory negligence.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The application of contributory negligence principles <\/span><b>allows courts to assess the relative fault of each party<\/b><span style=\"font-weight: 400;\"> and <\/span><b>determine the appropriate allocation of liability and damages<\/b><span style=\"font-weight: 400;\"> in such cases.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>But if both the plaintiff and the defendant take due care <\/b><span style=\"font-weight: 400;\">and all the measures <\/span><b>to avoid the accident<\/b><span style=\"font-weight: 400;\"> or the injury, <\/span><b>then the plaintiff cannot sue the defendant for that<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>The Burden of Proof<\/b><span style=\"font-weight: 400;\">: The burden of proof is <\/span><b>on the defendant<\/b><span style=\"font-weight: 400;\"> to prove that the plaintiff is equally liable for the act and the plaintiff was not careful, due to which he suffered injuries.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The <\/span><b>defence <\/b><span style=\"font-weight: 400;\">of contributory negligence is <\/span><b>not available when<\/b><span style=\"font-weight: 400;\"> it is proved that the <\/span><b>defendant has the duty to take full care<\/b><span style=\"font-weight: 400;\"> and <\/span><b>he is legally bound to take full care and diligence.<\/b><span style=\"font-weight: 400;\"> So, if any injury is caused to the plaintiff, then the defendant will be held liable.<\/span>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">For example- A and B were travelling in a bus, and A, in order to show something to B, pointed his hand outside the window, and the window suddenly got open, and A was injured.
