text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Clean Slate Doctrine is a <\/span><b>key legal principle embedded in<\/b><span style=\"font-weight: 400;\"> the <\/span><b>Insolvency and Bankruptcy Code, 2016 (\u201cIBC\u201d),<\/b><span style=\"font-weight: 400;\"> which plays a pivotal role in the corporate insolvency process in India.\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The doctrine <\/span><b>suggests that once a company successfully undergoes the insolvency resolution process<\/b> <b>and is taken over by a new buye<\/b><span style=\"font-weight: 400;\">r, the <\/span><b>new owner <\/b><span style=\"font-weight: 400;\">should <\/span><b>not be held accountable for any of the company\u2019s pre-existing debts, penalties, or liabilities.<\/b><span style=\"font-weight: 400;\">\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This principle is <\/span><b>designed to give the company a fresh start<\/b><span style=\"font-weight: 400;\">, essentially, <\/span><b>a \u201cclean slate\u201d <\/b><span style=\"font-weight: 400;\">free from the baggage of its prior financial troubles.\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Clean Slate Doctrine has been<\/span><b> upheld in several landmark rulings by <\/b><span style=\"font-weight: 400;\">India\u2019s <\/span><b>Supreme Court (SC),<\/b><span style=\"font-weight: 400;\"> reaffirming its crucial role in the IBC framework.<\/span>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the<\/span><b> Essar Steel India case,<\/b><span style=\"font-weight: 400;\"> the SC emphasized that one of the primary objectives of the IBC is to streamline insolvency procedures in India and bring all claims under a unified system.\u00a0\u00a0<\/span>\n<ul>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The SC <\/span><b>ruled that once a resolution plan is approved by t<\/b><span style=\"font-weight: 400;\">he <a href=\"https:\/\/vajiramandravi.com\/current-affairs\/national-company-law-tribunal-nclt\/\" target=\"_blank\"><strong>National Company Law Tribunal<\/strong> <\/a><\/span><b>(NCLT), any and all previous liabilities, including debts and penalties, <\/b><span style=\"font-weight: 400;\">are extinguished.\u00a0\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This means <\/span><b>no party can initiate or continue any legal proceedings related to a claim that is not included in the approved resolution plan.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">In the <\/span><b>Edelweiss Asset Reconstruction case,<\/b><span style=\"font-weight: 400;\"> the <\/span><b>SC held that government dues, <\/b><span style=\"font-weight: 400;\">such as taxes and duties, <\/span><b>are extinguished if they are not part of the resolution plan.\u00a0 <\/b><\/li>\n<li style=\"font-weight: 400;
