text-align: justify;\" aria-level=\"1\"><b>In India, surrogacy is regulated by the Surrogacy Regulation Act, 2021.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This act <\/span><b>prohibits commercial surrogacy.\u00a0<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The object of this Act is to prevent the exploitation of the women who may be lured into the arrangements of the commercial surrogacy.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Under the provisions of the Act <\/span><b>altruistic surrogacy is permitted <\/b><span style=\"font-weight: 400;\">whereby the surrogate mother is required to carry the child to help another individual or couple<\/span><b> without receiving the monetary benefit other than medical and insurance expenses.<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It provides for the <\/span><b>prohibition and regulation of surrogacy clinics.<\/b><span style=\"font-weight: 400;\"> It states that <\/span><b>\u201cNo Surrogacy Clinic shall conduct <\/b><span style=\"font-weight: 400;\">or associate with or assist in the performance of the <\/span><b>activities relating to the surrogacy and surrogacy procedures unless such clinic has been registered<\/b><span style=\"font-weight: 400;\"> under this Act\u201d.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It <\/span><b>prohibits any person or entity, <\/b><span style=\"font-weight: 400;\">including the surrogacy clinic, paediatrician, gynaecologist, embryologist, or even the registered medical practitioner <\/span><b>to engage in any form of the commercial surrogacy practices.<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It further <\/span><b>prohibits the abortion during the period of the surrogacy without the written consent of the surrogate mother and the registered medical practitioner, <\/b><span style=\"font-weight: 400;\">including the gynaecologist, paediatrician, and embryologist.<\/span><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><b>Surrogacy procedures shall not be performed<\/b><span style=\"font-weight: 400;\"> or initiated <\/span><b>unless the certificate of essentiality is obtained by the intended couple.<\/b><\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It provides that a <\/span><b>surrogate must be a woman<\/b><span style=\"font-weight: 400;\"> who has been <\/span><b>married and has at least one child of her own.\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><b>She must be between the age of 25 -35 years<\/b><span style=\"font-weight: 400;\"> on the date of implantation.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The s<\/span><b>urrogate mother should refrain from providing her own gametes<\/b> <b>and from acting as a surrogate mother more than once.<\/b><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400; text-align: justify;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It states that the<\/span><b> intended couple must be married.\u00a0<\/b>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">The <\/span><b>women <\/b><span style=\"font-weight: 400;\">must be between the age of <\/span><b>23-50 years, <\/b><span style=\"font-weight: 400;\">and the <\/span><b>man <\/b><span style=\"font-weight: 400;\">must be between the age of <\/span><b>26-55 years on the date of the certification.<\/b><span style=\"font-weight: 400;\">\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Intended partners must have been <\/span><b>married for the period of 5 years and must be nationals of India.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">Further it states that the<\/span><b> intended couple should not have any surviving children, <\/b><span style=\"font-weight: 400;\">whether biologically or through adoption or from any earlier surrogacy procedures.<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;
