Company Law Appellate Tribunal<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It is a quasi-judicial body <\/span><b>constituted under the Companies Act, 2013<\/b><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It was established to hear appeals against the decisions of the <\/span><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/national-company-law-tribunal-nclt\/\" target=\"_blank\"><b>National Company Law Tribunal (NCLT)<\/b><\/a><span style=\"font-weight: 400;\">.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Objectives:<\/b><span style=\"font-weight: 400;\"> To promote <\/span><b>timely corporate dispute resolution<\/b><span style=\"font-weight: 400;\">, ensure transparency, and improve efficiency in insolvency and corporate governance matters.<\/span><\/li>\n<\/ul>\n<h2><b>Functions of NCLAT<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hearing appeals against orders of the <\/span>Insolvency and Bankruptcy Board<span style=\"font-weight: 400;\"> of India (IBBI).\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Hearing appeals<\/b><span style=\"font-weight: 400;\"> against orders of the <\/span><b><a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/competition-commission-of-india\/\" target=\"_blank\">Competition Commission of India<\/a> (CCI).<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Hearing appeals related to the <\/span><b>National Financial Reporting Authority<\/b><span style=\"font-weight: 400;\"> (<strong><a href=\"https:\/\/vajiramandravi.com\/current-affairs\/nfra\/\" target=\"_blank\">NFRA<\/a><\/strong>).<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Giving advisory aria-level=\"1\"><b>Composition:<\/b><span style=\"font-weight: 400;\"> It includes a <\/span><b>Chairperson,<\/b><span style=\"font-weight: 400;\"> along with <\/span><b>Judicial and Technical Members,<\/b><span style=\"font-weight: 400;\"> all appointed by the Central Government based on expertise in law, finance, accountancy, and administration.<\/span><\/li>\n<\/ul>\n<h2><b>Powers and Procedure<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">NCLAT can <\/span><b>regulate its own procedure<\/b><span style=\"font-weight: 400;\"> and possess powers equivalent to a civil court under the Civil Procedure Code, 1908.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">It can summon witnesses, receive affidavits, enforce production of documents, and issue commissions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Orders passed by NCLAT are <\/span><b>enforceable like civil court decrees.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Appeals against NCLAT orders<\/b><span style=\"font-weight: 400;\"> can be filed in <\/span><b>the <a href=\"https:\/\/vajiramandravi.com\/upsc-exam\/supreme-court-of-india\/\" target=\"_blank\">Supreme Court of India<\/a>.<\/b><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Civil courts have no jurisdiction over matters within the purview of NCLAT.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">No court or authority can grant injunctions against any action taken by NCLAT under its legal authority.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Timely disposal:<\/b><span style=\"font-weight: 400;\"> NCLAT is required to dispose of appeals within six months from the date of receipt to ensure swift
