


{"id":7179,"date":"2022-11-02T08:19:28","date_gmt":"2022-11-02T02:49:28","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=7179"},"modified":"2025-03-28T17:45:45","modified_gmt":"2025-03-28T12:15:45","slug":"sedition","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/sedition\/","title":{"rendered":"Sedition"},"content":{"rendered":"<h2><strong>About Sedition:<\/strong><\/h2>\n<ul>\n<li><strong>View of Constitution:<\/strong>\u00a0The Constitution of India does not define the word sedition.<\/li>\n<li><strong>View of Indian Penal Code (IPC): Section 124-A\u00a0of the IPC<\/strong>\u00a0defines the offence of \u2018Sedition\u2019 \u2013\n<ul>\n<li>Whoever, by words (or by signs or visible representation) attempts to bring into hatred or contempt, or excites or attempts to excite disaffection towards the Government shall be punished with life imprisonment.<\/li>\n<li>The word\u00a0\u2018disaffection\u2019\u00a0in this section includes disloyalty and feelings of enmity.<\/li>\n<li>However, Comments expressing disapproval of the &#8216;Government action without attempting to excite disaffection, do not constitute an offense under this section\u2019.<\/li>\n<\/ul>\n<\/li>\n<li><strong>View of judiciary on sedition:<\/strong>\n<ul>\n<li>In\u00a0<strong>Kedar Nath Singh\u2019s Case<\/strong>,\u00a0the Constitution bench of the Supreme Court made it clear that allegedly seditious speech and expression may be punished only if the speech is an \u2018incitement\u2019 to \u2018violence\u2019, or \u2018public disorder\u2019.<\/li>\n<li>In\u00a0<strong>Indra Das v. State of Assam and Arup Bhuyan v. State of Assam<\/strong>,\u00a0the Supreme Court unambiguously stated that only speech that amounts to \u201cincitement to imminent lawless action\u201d can be criminalised.<\/li>\n<li>In\u00a0<strong>Shreya Singhal v. Union of India<\/strong>,\u00a0the famous 66A judgment, the Supreme Court drew a clear distinction between \u201cadvocacy\u201d and \u201cincitement\u201d, stating that only the latter could be punished.<\/li>\n<li>Thus,\u00a0words and speech\u00a0can be criminalised and punished only in situations\u00a0where it is being used to incite mobs or crowds to violent action.\u00a0Mere words and phrases by themselves, no matter how distasteful, do not amount to a criminal offence unless this condition is met.<\/li>\n<\/ul>\n<\/li>\n<li><strong>History:<\/strong>\n<ul>\n<li>Sedition was not a part of original IPC in the 1860s\u00a0and was even dropped from the law.
