


{"id":74369,"date":"2025-11-21T11:24:42","date_gmt":"2025-11-21T05:54:42","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=74369"},"modified":"2025-11-21T11:24:42","modified_gmt":"2025-11-21T05:54:42","slug":"immigrants-expulsion-act-1950-explained-assams-first-deportation-orders","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/immigrants-expulsion-act-1950-explained-assams-first-deportation-orders\/","title":{"rendered":"Immigrants Expulsion Act 1950 Explained: Assam\u2019s First Deportation Orders"},"content":{"rendered":"<h2><b>Immigrants Expulsion Act 1950 Latest News<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Assam has invoked the <\/span><i><span style=\"font-weight: 400;\">Immigrants (Expulsion from Assam) Act, 1950<\/span><\/i><span style=\"font-weight: 400;\"> for the first time since the state cabinet <\/span><b>approved its use<\/b><span style=\"font-weight: 400;\"> earlier this year.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Sonitpur district administration has ordered five people\u2014four women and one man\u2014who were declared foreigners by a tribunal in 2024, to leave India within 24 hours.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">However, the individuals are currently untraceable, with police stating they have been \u201cabsconding,\u201d and locals claiming they left the area over a decade ago.<\/span><\/li>\n<\/ul>\n<h2><b>About Immigrants (Expulsion from Assam) Act, 1950<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Immigrants Expulsion from Assam Act (IEAA) was enacted on March 1, 1950, in response to the Assam government\u2019s demand for a legal mechanism to control large-scale migration from East Pakistan after Partition.\u00a0<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Migration had already become a major political and demographic concern in the state.<\/span><\/li>\n<\/ul>\n<h3><b>Why the Centre Drafted the Law<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Since citizenship is a Union subject, the Central government drafted the Act and delegated specific powers to Assam.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Originally, it was even named the Undesirable Immigrants (Expulsion from Assam) Act, highlighting its intent.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Recognising post-Partition instability, the Act <\/span><b>excluded refugees<\/b><span style=\"font-weight: 400;\">, stating that people displaced due to \u201ccivil disturbances\u201d in Pakistan would not be subject to expulsion under the law.<\/span><\/li>\n<\/ul>\n<h3><b>Powers Granted Under the Act<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Act empowered the Centre to order anyone:<\/span>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">who was ordinarily a resident outside India,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">who entered Assam before or after 1950, and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"2\"><span style=\"font-weight: 400;\">whose presence was deemed \u201cdetrimental\u201d to India\u2019s general public or to any Scheduled Tribe in Assam,<\/span><\/li>\n<\/ul>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">to <\/span><b>remove themselves from Assam or India<\/b><span style=\"font-weight: 400;\"> within a specified time and through a designated route.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The law authorised any officer of the Union government or Assam government to implement these expulsion orders.<\/span><\/li>\n<\/ul>\n<h2><b>Application of the Immigrants (Expulsion from Assam) Act, 1950<\/b><\/h2>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The Act was applied only briefly. Its enforcement faced practical and political challenges almost immediately after it came into effect.<\/span><\/li>\n<\/ul>\n<h3><b>Communal Tension and Mass Exodus<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Historians note that while the Act was being finalised, communal violence in Lower Assam led to 40,000 to 1 lakh Muslims fleeing to East Pakistan.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">This made identification of \u201cimmigrants\u201d difficult because many affected individuals were actually Assam\u2019s original residents, especially Bengali Muslims.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A triggering incident involved an old Assamese Muslim resident being ordered to leave within three days, which angered the then PM Nehru.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">He objected to the implementation of such orders during a sensitive time.<\/span><\/li>\n<\/ul>\n<h3><b>Nehru\u2013Liaquat Pact Influence<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">The timing coincided with the Nehru\u2013Liaquat Pact (April 1950), aimed at safeguarding minorities in both India and Pakistan.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Pakistan\u2019s PM Liaquat Ali Khan raised concerns about Assam\u2019s expulsion orders.<\/span><\/li>\n<\/ul>\n<h3><b>Centre Orders Suspension of the Act<\/b><\/h3>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">On April 10, 1950, two days after the pact, Nehru wrote to the then Assam CM Gopinath Bordoloi instructing him to stop all action under the IEAA.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nehru stressed that minority safety and restoring peace were the top priorities \u2014 continuing expulsions would worsen tensions.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Historical accounts suggest that <\/span><b>only a few hundred people<\/b><span
