


{"id":8116,"date":"2022-11-19T04:34:36","date_gmt":"2022-11-18T23:04:36","guid":{"rendered":"https:\/\/vajiramandravi.com\/current-affairs\/?p=8116"},"modified":"2025-11-22T17:07:43","modified_gmt":"2025-11-22T11:37:43","slug":"posco-act-upsc","status":"publish","type":"post","link":"https:\/\/vajiramandravi.com\/current-affairs\/posco-act-upsc\/","title":{"rendered":"POSCO Act"},"content":{"rendered":"<h2><strong>About POSCO Act:<\/strong><\/h2>\n<ul>\n<li>The analysis, titled\u00a0<strong>\u2018A Decade of POCSO\u2019<\/strong>, was carried out by the Justice, Access and Lowering Delays in India (JALDI) Initiative at Vidhi Centre for Legal Policy, in collaboration with the Data Evidence for Justice Reform (DE JURE) program at the World Bank.<\/li>\n<\/ul>\n<h3><strong>Findings:<\/strong><\/h3>\n<ul>\n<li><strong>Acquittals:<\/strong>\u00a0The analysis has found that 43.44% of trials under POCSO end in acquittals while only 14.03% end in convictions.<\/li>\n<li>For every one conviction in a POCSO case, there are three acquittals.<\/li>\n<li>Acquittals are significantly higher than convictions for all the states studied.\n<ul>\n<li>For instance, in Andhra Pradesh, acquittals are seven times more than convictions; and in West Bengal, acquittals are five times more than convictions.<\/li>\n<li>In Kerala, the gap between acquittal and conviction is not very high with acquittals constituting 20.5% of the total disposals and convictions constituting 16.49%.<\/li>\n<\/ul>\n<\/li>\n<li>As per data published by the\u00a0<strong>National Crime Record Bureau in 2021, in 96% of the cases filed under the POCSO Act, 2012<\/strong>, the accused was a person known to the child victim \u2013 in 48.66% of cases, the accused is either a friend or a romantic partner of the victim.<\/li>\n<li>The study has found on average, it\u00a0<strong>takes 509.78 days for a POCSO case<\/strong>\u00a0to be disposed of \u2013 whereas it has been stipulated under the Act that such cases need to be disposed of within a year.<\/li>\n<li><strong>Delhi has the highest number of POCSO trials\u00a0<\/strong>in the country with 13.54 cases per 100,000 population in 2018 \u2013 which does not necessarily mean the number of incidents of sexual offences is higher, but that there is increasing awareness and reporting of cases.<\/li>\n<li><strong>Time taken:<\/strong>\n<ul>\n<li><strong>Chandigarh\u00a0and West Bengal<\/strong>\u00a0are the only states where the average time taken for convictions is within one year.<\/li>\n<li>States like Chhattisgarh, Haryana, Kerala, Sikkim, Chandigarh and the NCT of Delhi seem to have a much higher reporting of POCSO cases.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Pendency:<\/strong>\n<ul>\n<li>Uttar Pradesh has the highest pendency with more than three-fourths (77.77%) of the total POCSO cases filed between November 2012 and February 2021 pending.<\/li>\n<li>On the other hand, at 80.2%, Tamil Nadu has the highest disposal percentage.<\/li>\n<\/ul>\n<\/li>\n<li><strong>Support Persons:<\/strong>\n<ul>\n<li>According to the study, \u201csupport persons\u201d are not being appointed in most POCSO cases.<\/li>\n<li>The Supreme Court had also noted that in 96% of cases, a support person was not provided to the victim.\n<ul>\n<li>A\u00a0<strong>support person<\/strong>\u00a0may be a person or organisation working in the field of child rights or child protection, an official of a children\u2019s home or a shelter home having custody of the child, or a person employed by the District Child Protection Unit (DCPU), who hand holds the victim through the entire legal process.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<\/li>\n<li><strong>POCSO courts:<\/strong>\n<ul>\n<li>The analysis further notes POCSO courts have not been designated in all districts.<\/li>\n<li>As of 2022, 408 POCSO courts have been set up in 28 States as part of the Government\u2019s Fast Track Special Court\u2019s Scheme.<\/li>\n<li>There is a lack of Special Public Prosecutors appointed specifically to handle POCSO cases.<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n<p>&nbsp;<\/p>\n<hr \/>\n<p><strong>Source :<\/strong><strong>\u00a0<\/strong><a href=\"https:\/\/indianexpress.com\/article\/explained\/explained-law\/10-years-of-pocso-an-analysis-of-indias-landmark-child-abuse-law-8276030\/\" target=\"_blank\" rel=\"nofollow noopener\">Indian Express<\/a><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The POSCO Act is a law in India that protects children from sexual offenses.<\/p>\n","protected":false},"author":5,"featured_media":8117,"comment_status":"closed","ping_status":"closed","sticky":false,"template":"","format":"standard","meta":{"_acf_changed":false,"footnotes":""},"categories":[1],"tags":[],"class_list":{"0":"post-8116","1":"post","2":"type-post","3":"status-publish","4":"format-standard","5":"has-post-thumbnail","7":"category-upsc-prelims-current-affairs","8":"no-featured-image-padding"},"acf":[],"_links":{"self":[{"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/posts\/8116","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/posts"}],"about":[{"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/types\/post"}],"author":[{"embeddable":true,"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/users\/5"}],"replies":[{"embeddable":true,"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/comments?post=8116"}],"version-history":[{"count":0,"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/posts\/8116\/revisions"}],"wp:featuredmedia":[{"embeddable":true,"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/media\/8117"}],"wp:attachment":[{"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/media?parent=8116"}],"wp:term":[{"taxonomy":"category","embeddable":true,"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/categories?post=8116"},{"taxonomy":"post_tag","embeddable":true,"href":"https:\/\/vajiramandravi.com\/current-affairs\/wp-json\/wp\/v2\/tags?post=8116"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
